| 8 | 8 | | certain amounts in the General Appropriations Act. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter F, Chapter 48, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 48.2511 to read as follows: |
|---|
| 12 | 12 | | Sec. 48.2511. APPROPRIATION FOR PUBLIC EDUCATION. (a) In |
|---|
| 13 | 13 | | each biennial General Appropriations Act, the legislature shall set |
|---|
| 14 | 14 | | the basic allotment under Section 48.051 and the dollar amount |
|---|
| 15 | 15 | | guaranteed level of state and local funds per weighted student per |
|---|
| 16 | 16 | | cent of tax effort ("GL") under Section 48.202 for each state fiscal |
|---|
| 17 | 17 | | year at: |
|---|
| 18 | 18 | | (1) the amounts necessary for the amount of state |
|---|
| 19 | 19 | | funds to which all school districts are jointly entitled under this |
|---|
| 20 | 20 | | chapter, together with state funds to which all school districts |
|---|
| 21 | 21 | | are jointly entitled for that state fiscal year under any other law |
|---|
| 22 | 22 | | that provides funding for the general maintenance and operation of |
|---|
| 23 | 23 | | the system of public free schools, to constitute, as determined by |
|---|
| 24 | 24 | | the legislature, at least 50 percent of the cost of maintaining and |
|---|
| 25 | 25 | | operating that system; or |
|---|
| 26 | 26 | | (2) amounts greater than the amounts specified by |
|---|
| 27 | 27 | | Subdivision (1). |
|---|
| 28 | 28 | | (b) For purposes of calculating the amount of state funds |
|---|
| 29 | 29 | | required under Subsection (a), the legislature may not consider |
|---|
| 30 | 30 | | money that is attributable to an ad valorem tax imposed by a school |
|---|
| 31 | 31 | | district on property located in the school district, including any |
|---|
| 32 | 32 | | revenue the school district is required to transfer to the state to |
|---|
| 33 | 33 | | reduce the school district's local revenue level in accordance with |
|---|
| 34 | 34 | | Chapter 49. |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect December 1, 2023. |
