66 relating to the adoption of a water conservation program by a

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 562, Local Government Code, is amended
1010 by adding Subchapter C to read as follows:
1111 SUBCHAPTER C. WATER CONSERVATION
1212 Sec. 562.051. WATER CONSERVATION PROGRAMS. (a) In this
1313 section, "agricultural operation" has the meaning assigned by
1414 Section 251.002, Agriculture Code.
1515 (b) The commissioners court of a county by order may adopt a
1616 water conservation program. A water conservation program adopted
1717 under this section may establish for the unincorporated area of the
1818 county only:
1919 (1) rules for residential water use restrictions
2020 during periods of drought; and
2121 (2) water conservation standards applicable to the
2222 residential development of a subdivision of a tract of land, the
2323 development of which begins after August 31, 2024.
2424 (c) Water use restrictions established under Subsection
2525 (b)(1) may not apply to an agricultural operation.
2626 (d) To the extent of a conflict between a county order
2727 adopted under this section and a municipal ordinance regulating the
2828 same conduct, the ordinance prevails.
2929 SECTION 2. This Act takes effect January 1, 2024.
