8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Chapter 562, Local Government Code, is amended |
---|
10 | 10 | | by adding Subchapter C to read as follows: |

11 | 11 | | SUBCHAPTER C. WATER CONSERVATION |
---|
12 | 12 | | Sec. 562.051. WATER CONSERVATION PROGRAMS. (a) In this |
---|
13 | 13 | | section, "agricultural operation" has the meaning assigned by |
---|
14 | 14 | | Section 251.002, Agriculture Code. |
---|
15 | 15 | | (b) The commissioners court of a county by order may adopt a |
---|
16 | 16 | | water conservation program. A water conservation program adopted |
---|
17 | 17 | | under this section may establish for the unincorporated area of the |
---|
18 | 18 | | county only: |
---|
19 | 19 | | (1) rules for residential water use restrictions |
---|
20 | 20 | | during periods of drought; and |
---|
21 | 21 | | (2) water conservation standards applicable to the |
---|
22 | 22 | | residential development of a subdivision of a tract of land, the |
---|
23 | 23 | | development of which begins after August 31, 2024. |
---|
24 | 24 | | (c) Water use restrictions established under Subsection |
---|
25 | 25 | | (b)(1) may not apply to an agricultural operation. |
---|
26 | 26 | | (d) To the extent of a conflict between a county order |
---|
27 | 27 | | adopted under this section and a municipal ordinance regulating the |
---|
28 | 28 | | same conduct, the ordinance prevails. |
---|
29 | 29 | | SECTION 2. This Act takes effect January 1, 2024. |
