44 A JOINT RESOLUTION
55 proposing a constitutional amendment requiring the state to expand

88 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article XVI, Texas Constitution, is amended by
1010 adding Section 74 to read as follows:
1111 Sec. 74. The state shall provide medical assistance to all
1212 persons who apply for that assistance and for whom federal matching
1313 funds are available under the Patient Protection and Affordable
1414 Care Act (Pub. L. No. 111-148), as amended by the Health Care and
1515 Education Reconciliation Act of 2010 (Pub. L. No. 111-152), to the
1616 state to provide that assistance.
1717 SECTION 2. The following temporary provision is added to
1818 the Texas Constitution:
1919 TEMPORARY PROVISION. (a) This temporary provision applies
2020 to the constitutional amendment proposed by the 88th Legislature,
2121 2nd Called Session, 2023, requiring the state to expand eligibility
2222 for Medicaid to all persons for whom federal matching funds are
2323 available under the federal Patient Protection and Affordable Care
2424 Act.
2525 (b) Section 74, Article XVI, of this constitution takes
2626 effect January 1, 2024.
2727 (c) This temporary provision expires January 1, 2025.
2828 SECTION 3. This proposed constitutional amendment shall be
2929 submitted to the voters at an election to be held November 7, 2023.
3030 The ballot shall be printed to provide for voting for or against the
3131 proposition: "The constitutional amendment requiring the state to
3232 expand eligibility for Medicaid to all persons for whom federal
3333 matching funds are available under the federal Patient Protection
3434 and Affordable Care Act."
