55 A JOINT RESOLUTION
66 proposing a constitutional amendment providing requirements for
77 the exercise of the power of impeachment by the House of
88 Representatives and providing that officers against whom articles
99 of impeachment are preferred receive pay during the pendency of
1010 impeachment proceedings.
1111 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1, Article XV, Texas Constitution, is
1313 amended to read as follows:
1414 Sec. 1. (a) The power of impeachment shall be vested in the
1515 House of Representatives.
1616 (b) When exercising the power of impeachment, the House of
1717 Representatives must:
1818 (1) conduct a thorough, even-handed investigation of
1919 all articles of impeachment;
2020 (2) ensure all testimony presented to and considered
2121 by the House of Representatives is provided under oath;
2222 (3) provide any officer against whom articles of
2323 impeachment may be preferred and the officer's legal counsel the
2424 opportunity to:
2525 (A) be present during all hearings before the
2626 House of Representatives and committees of the House of
2727 Representatives; and
2828 (B) examine the witnesses and evidence against
2929 the officer; and
3030 (4) provide the members of the House of
3131 Representatives at least 14 calendar days to review all records
3232 pertaining to articles of impeachment before voting on the articles
3333 of impeachment.
3434 SECTION 2. Section 5, Article XV, Texas Constitution, is
3535 amended to read as follows:
3636 Sec. 5. All officers against whom articles of impeachment
3737 may be preferred shall be suspended, with pay, from the exercise of
3838 the duties of their office[,] during the pendency of such
3939 impeachment. The Governor may make a provisional appointment to
4040 fill the vacancy[,] occasioned by the suspension of an officer
4141 until the decision on the impeachment.
4242 SECTION 3. The following temporary provision is added to
4343 the Texas Constitution:
4444 TEMPORARY PROVISION. (a) This temporary provision applies
4545 to the constitutional amendment proposed by the 88th Legislature,
4646 3rd Called Session, 2023, providing requirements for the exercise
4747 of the power of impeachment by the House of Representatives and
4848 providing that officers against whom articles of impeachment are
4949 preferred receive pay during the pendency of impeachment
5050 proceedings.
5151 (b) The amendments to Sections 1 and 5, Article XV, of this
5252 constitution take effect January 1, 2025, and apply only to an
5353 impeachment that is subject to a vote by the House of
5454 Representatives on the question of impeachment on or after that
5555 date.
5656 (c) This temporary provision expires January 1, 2026.
5757 SECTION 4. This proposed constitutional amendment shall be
5858 submitted to the voters at an election to be held November 5, 2024.
5959 The ballot shall be printed to permit voting for or against the
6060 proposition: "The constitutional amendment providing requirements
6161 for the exercise of the power of impeachment by the House of
6262 Representatives and providing that officers against whom articles
6363 of impeachment are preferred receive pay during the pendency of
6464 impeachment proceedings."
