66 AN ACT
77 relating to bond requirements for certain judges.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 25.0006(a-1) and (a-4), Government
1010 Code, are amended to read as follows:
1111 (a-1) Before beginning the duties of the office, the judge
1212 of a statutory county court must execute a bond that:
1313 (1) is payable to the treasurer of the county;
1414 (2) is in the amount set by the commissioners court of:
1515 (A) subject to Paragraph (B), not less than
1616 $1,000 nor more than $10,000; or
1717 (B) for a judge presiding in the court over
1818 guardianship proceedings, as defined by Section 1002.015, Estates
1919 Code, or over probate proceedings, as defined by Section 22.029,
2020 Estates Code, not less than $500,000[:
2121 [(i) $100,000 for a court in a county with a
2222 population of 125,000 or less; or
2323 [(ii) $250,000 for a court in a county with
2424 a population of more than 125,000]; and
2525 (3) is conditioned that the judge will:
2626 (A) faithfully perform all duties of office; and
2727 (B) for a judge presiding in the court over
2828 guardianship or probate proceedings, perform the duties required by
2929 the Estates Code.
3030 (a-4) This section does not apply to:
3131 (1) [a judge of a statutory county court who does not
3232 preside over guardianship proceedings, as defined by Section
3333 1002.015, Estates Code;
3434 [(2)] a judge of a statutory probate court who
3535 executes a bond, obtains insurance, or self-insures pursuant to
3636 Section 25.00231; or
3737 (2) [(3)] a judge who presides over a county criminal
3838 court.
3939 SECTION 2. Section 26.001(a), Government Code, is amended
4040 to read as follows:
4141 (a) Before beginning the duties of the office, the county
4242 judge must execute a bond that:
4343 (1) is payable to the treasurer of the county;
4444 (2) is in the amount set by the commissioners court of:
4545 (A) subject to Paragraph (B), not less than
4646 $1,000 nor more than $10,000; or
4747 (B) for a county judge presiding in the county
4848 court over guardianship proceedings, as defined by Section
4949 1002.015, Estates Code, or over probate proceedings, as defined by
5050 Section 22.029, Estates Code, not less than $500,000[:
5151 [(i) $100,000 for a court in a county with a
5252 population of 125,000 or less; or
5353 [(ii) $250,000 for a court in a county with
5454 a population of more than 125,000]; and
5555 (3) is conditioned that the judge will:
5656 (A) faithfully perform all duties of office; and
5757 (B) for a county judge presiding in the county
5858 court over guardianship or probate proceedings, perform the duties
5959 required by the Estates Code.
6060 SECTION 3. This Act takes effect on the 91st day after the
6161 last day of the legislative session.
