7 | 7 | | relating to the applicability of certain requirements relating to |

8 | 8 | | parental rights, open records, and public information to school |
---|
9 | 9 | | districts designated as districts of innovation. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 12A.004(a), Education Code, is amended |
---|
12 | 12 | | to read as follows: |
---|
13 | 13 | | (a) A local innovation plan may not provide for the |
---|
14 | 14 | | exemption of a district designated as a district of innovation from |
---|
15 | 15 | | or limit the applicability of [the following provisions of this |
---|
16 | 16 | | title]: |
---|
17 | 17 | | (1) a state or federal requirement applicable to an |
---|
18 | 18 | | open-enrollment charter school operating under Subchapter D, |
---|
19 | 19 | | Chapter 12; |
---|
20 | 20 | | (2) Subchapters A, C, D, and E, Chapter 11, except that |
---|
21 | 21 | | a district may be exempt from Sections 11.1511(b)(5) and (14) and |
---|
22 | 22 | | Section 11.162; |
---|
23 | 23 | | (3) any parental right or entitlement described or |
---|
24 | 24 | | provided under Chapter 26; |
---|
25 | 25 | | (4) [(3)] state curriculum and graduation |
---|
26 | 26 | | requirements adopted under Chapter 28; [and] |
---|
27 | 27 | | (5) [(4)] academic and financial accountability and |
---|
28 | 28 | | sanctions under Chapters 39 and 39A; or |
---|
29 | 29 | | (6) any requirement under Chapter 551 or 552, |
---|
30 | 30 | | Government Code. |

31 | 31 | | SECTION 2. Section 12A.008, Education Code, is amended by |
---|
32 | 32 | | adding Subsection (b-2) to read as follows: |
---|
33 | 33 | | (b-2) The commissioner may terminate a district's |
---|
34 | 34 | | designation as a district of innovation if the district's local |
---|
35 | 35 | | innovation plan exempts the district from a provision or limits the |
---|
36 | 36 | | application of a provision in violation of Section 12A.004(a)(3) or |
---|
37 | 37 | | (6). |
---|
38 | 38 | | SECTION 3. Section 12A.004(a), Education Code, as amended |
---|
39 | 39 | | by this Act, applies to each local innovation plan adopted under |
---|
40 | 40 | | Chapter 12A, Education Code, regardless of whether the plan was |
---|
41 | 41 | | adopted before, on, or after the effective date of this Act. A local |
---|
42 | 42 | | innovation plan adopted or renewed before the effective date of |
---|
43 | 43 | | this Act must comply with Section 12A.004(a), Education Code, as |
---|
44 | 44 | | amended by this Act, not later than the 91st day after the last day |
---|
45 | 45 | | of the legislative session. |
---|
46 | 46 | | SECTION 4. Section 12A.008(b-2), Education Code, as added |
---|
47 | 47 | | by this Act, applies beginning on the 91st day after the last day of |
---|
48 | 48 | | the legislative session. |
---|
49 | 49 | | SECTION 5. This Act takes effect immediately if it receives |
---|
50 | 50 | | a vote of two-thirds of all the members elected to each house, as |
---|
51 | 51 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
52 | 52 | | Act does not receive the vote necessary for immediate effect, this |
---|
53 | 53 | | Act takes effect on the 91st day after the last day of the |
---|
54 | 54 | | legislative session. |
