55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the applicability of certain requirements relating to
88 parental rights, open records, and public information to school
99 districts designated as districts of innovation.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 12A.004(a), Education Code, is amended
1212 to read as follows:
1313 (a) A local innovation plan may not provide for the
1414 exemption of a district designated as a district of innovation from
1515 or limit the applicability of [the following provisions of this
1616 title]:
1717 (1) a state or federal requirement applicable to an
1818 open-enrollment charter school operating under Subchapter D,
1919 Chapter 12;
2020 (2) Subchapters A, C, D, and E, Chapter 11, except that
2121 a district may be exempt from Sections 11.1511(b)(5) and (14) and
2222 Section 11.162;
2323 (3) any parental right or entitlement described or
2424 provided under Chapter 26;
2525 (4) [(3)] state curriculum and graduation
2626 requirements adopted under Chapter 28; [and]
2727 (5) [(4)] academic and financial accountability and
2828 sanctions under Chapters 39 and 39A; or
2929 (6) any requirement under Chapter 551 or 552,
3030 Government Code.
3131 SECTION 2. Section 12A.008, Education Code, is amended by
3232 adding Subsection (b-2) to read as follows:
3333 (b-2) The commissioner may terminate a district's
3434 designation as a district of innovation if the district's local
3535 innovation plan exempts the district from a provision or limits the
3636 application of a provision in violation of Section 12A.004(a)(3) or
3737 (6).
3838 SECTION 3. Section 12A.004(a), Education Code, as amended
3939 by this Act, applies to each local innovation plan adopted under
4040 Chapter 12A, Education Code, regardless of whether the plan was
4141 adopted before, on, or after the effective date of this Act. A local
4242 innovation plan adopted or renewed before the effective date of
4343 this Act must comply with Section 12A.004(a), Education Code, as
4444 amended by this Act, not later than the 91st day after the last day
4545 of the legislative session.
4646 SECTION 4. Section 12A.008(b-2), Education Code, as added
4747 by this Act, applies beginning on the 91st day after the last day of
4848 the legislative session.
4949 SECTION 5. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect on the 91st day after the last day of the
5454 legislative session.
