| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Sections 12.106(a-2) and (d), Education Code, |
|---|
| 10 | 10 | | are amended to read as follows: |
|---|
| 11 | 11 | | (a-2) In addition to the funding provided by Subsection (a), |
|---|
| 12 | 12 | | a charter holder is entitled to receive for the open-enrollment |
|---|
| 13 | 13 | | charter school an allotment per student in average daily attendance |
|---|
| 14 | 14 | | in an amount equal to the difference between: |
|---|
| 15 | 15 | | (1) the product of: |
|---|
| 16 | 16 | | (A) the quotient of: |
|---|
| 17 | 17 | | (i) the total amount of funding provided to |
|---|
| 18 | 18 | | eligible school districts under Section 48.101(b) or (c); and |
|---|
| 19 | 19 | | (ii) the total number of students in |
|---|
| 20 | 20 | | average daily attendance in school districts that receive an |
|---|
| 21 | 21 | | allotment under Section 48.101(b) or (c); and |
|---|
| 22 | 22 | | (B) the sum of one and the quotient of: |
|---|
| 23 | 23 | | (i) the total number of students in average |
|---|
| 24 | 24 | | daily attendance in school districts that receive an allotment |
|---|
| 25 | 25 | | under Section 48.101(b) or (c); and |
|---|
| 26 | 26 | | (ii) the total number of students in |
|---|
| 27 | 27 | | average daily attendance in school districts statewide; and |
|---|
| 28 | 28 | | (2) $460 [$125]. |
|---|
| 29 | 29 | | (d) Subject to Subsection (e), in addition to other amounts |
|---|
| 30 | 30 | | provided by this section, a charter holder is entitled to receive, |
|---|
| 31 | 31 | | for the open-enrollment charter school, an annual allotment |
|---|
| 32 | 32 | | [funding] per student in average daily attendance [in an amount] |
|---|
| 33 | 33 | | equal to the basic allotment under Section 48.051 [guaranteed level |
|---|
| 34 | 34 | | of state and local funds per student per cent of tax effort under |
|---|
| 35 | 35 | | Section 46.032(a)] multiplied by 0.04 [the lesser of: |
|---|
| 36 | 36 | | [(1) the state average interest and sinking fund tax rate |
|---|
| 37 | 37 | | imposed by school districts for the current year; or |
|---|
| 38 | 38 | | [(2) a rate that would result in a total amount to which |
|---|
| 39 | 39 | | charter schools are entitled under this subsection for the current |
|---|
| 40 | 40 | | year equal to $60 million]. |
|---|
| 41 | 41 | | SECTION 2. This Act takes effect on the 91st day after the |
|---|
| 42 | 42 | | last day of the legislative session. |
