55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to increasing the criminal penalty for making a false
88 report of a bomb threat involving certain locations.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 42.06(b), Penal Code, is amended to read
1111 as follows:
1212 (b) An offense under this section is a Class A misdemeanor,
1313 except that the offense is:
1414 (1) a state jail felony if [unless] the false report is
1515 of an emergency involving a public or private institution of higher
1616 education or involving a public primary or secondary school, public
1717 communications, public transportation, public water, gas, or power
1818 supply or other public service; or
1919 (2) a felony of the third degree if the false report is
2020 of a bombing involving:
2121 (A) a public or private primary or secondary
2222 school;
2323 (B) a public or private institution of higher
2424 education;
2525 (C) a proprietary, vocational, or technical
2626 school; or
2727 (D) an established place of religious worship [,
2828 in which event the offense is a state jail felony].
2929 SECTION 2. The change in law made by this Act applies only
3030 to an offense committed on or after the effective date of this Act.
3131 An offense committed before the effective date of this Act is
3232 governed by the law in effect on the date the offense was committed,
3333 and the former law is continued in effect for that purpose. For
3434 purposes of this section, an offense was committed before the
3535 effective date of this Act if any element of the offense occurred
3636 before that date.
3737 SECTION 3. This Act takes effect on the 91st day after the
3838 last day of the legislative session.
