| 7 | 7 | | relating to increasing the criminal penalty for making a false |

| 8 | 8 | | report of a bomb threat involving certain locations. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 42.06(b), Penal Code, is amended to read |
|---|
| 11 | 11 | | as follows: |
|---|
| 12 | 12 | | (b) An offense under this section is a Class A misdemeanor, |
|---|
| 13 | 13 | | except that the offense is: |
|---|
| 14 | 14 | | (1) a state jail felony if [unless] the false report is |
|---|
| 15 | 15 | | of an emergency involving a public or private institution of higher |
|---|
| 16 | 16 | | education or involving a public primary or secondary school, public |
|---|
| 17 | 17 | | communications, public transportation, public water, gas, or power |
|---|
| 18 | 18 | | supply or other public service; or |
|---|
| 19 | 19 | | (2) a felony of the third degree if the false report is |
|---|
| 20 | 20 | | of a bombing involving: |
|---|
| 21 | 21 | | (A) a public or private primary or secondary |
|---|
| 22 | 22 | | school; |
|---|
| 23 | 23 | | (B) a public or private institution of higher |
|---|
| 24 | 24 | | education; |
|---|
| 25 | 25 | | (C) a proprietary, vocational, or technical |
|---|
| 26 | 26 | | school; or |
|---|
| 27 | 27 | | (D) an established place of religious worship [, |
|---|
| 28 | 28 | | in which event the offense is a state jail felony]. |
|---|
| 29 | 29 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 30 | 30 | | to an offense committed on or after the effective date of this Act. |
|---|
| 31 | 31 | | An offense committed before the effective date of this Act is |
|---|
| 32 | 32 | | governed by the law in effect on the date the offense was committed, |
|---|
| 33 | 33 | | and the former law is continued in effect for that purpose. For |
|---|
| 34 | 34 | | purposes of this section, an offense was committed before the |
|---|
| 35 | 35 | | effective date of this Act if any element of the offense occurred |
|---|
| 36 | 36 | | before that date. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect on the 91st day after the |
|---|
| 38 | 38 | | last day of the legislative session. |
