66 AN ACT
7- relating to permit fees for groundwater wells imposed by the
8- Southeast Texas Groundwater Conservation District.
7+ relating to the confidentiality of certain information for a
8+ current or former administrative law judge for the State Office of
9+ Administrative Hearings.
910 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10- SECTION 1. Section 8868.153, Special District Local Laws
11- Code, is amended to read as follows:
12- Sec. 8868.153. PERMIT FEES. (a) The district by rule may
13- impose a reasonable fee on each well that is not exempt from
14- regulation by the district and for which a permit is issued by the
15- district.
16- (b) The fee must be based on the amount of water to be
17- withdrawn from the well.
18- (c) The fee may not exceed seven cents [one cent] per
19- thousand gallons of groundwater withdrawn for any purpose.
20- SECTION 2. This Act takes effect immediately if it receives
21- a vote of two-thirds of all the members elected to each house, as
22- provided by Section 39, Article III, Texas Constitution. If this
23- Act does not receive the vote necessary for immediate effect, this
24- Act takes effect on the 91st day after the last day of the
25- legislative session.
11+ SECTION 1. Section 552.117, Government Code, is amended by
12+ adding Subsection (a-1) to read as follows:
13+ (a-1) In addition to the exceptions provided by Subsection
14+ (a), information is excepted from the requirements of Section
15+ 552.021 if it is information that:
16+ (1) relates to the home address, home telephone
17+ number, emergency contact information, or social security number of
18+ a current or former administrative law judge for the State Office of
19+ Administrative Hearings, regardless of whether the person complies
20+ with Section 552.024 or 552.1175; or
21+ (2) reveals whether a person described by Subdivision
22+ (1) has family members.
23+ SECTION 2. Section 552.1175, Government Code, is amended by
24+ adding Subsection (a-1) to read as follows:
25+ (a-1) In addition to the individuals described by
26+ Subsection (a), this section applies to a current or former
27+ administrative law judge for the State Office of Administrative
28+ Hearings.
29+ SECTION 3. Section 25.025, Tax Code, is amended by adding
30+ Subsection (a-2) to read as follows:
31+ (a-2) In addition to the individuals described by
32+ Subsection (a), this section applies to a current or former
33+ administrative law judge for the State Office of Administrative
34+ Hearings.
35+ SECTION 4. The changes in law made by this Act apply only to
36+ a request for information that is received by a governmental body or
37+ an officer on or after the effective date of this Act. A request for
38+ information that was received before the effective date of this Act
39+ is governed by the law in effect on the date the request was
40+ received, and the former law is continued in effect for that
41+ purpose.
42+ SECTION 5. This Act takes effect on the 91st day after the
43+ last day of the legislative session.
