| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter A, Chapter 501, Government Code, is |
|---|
| 10 | 10 | | amended by adding Section 501.028 to read as follows: |
|---|
| 11 | 11 | | Sec. 501.028. AIR CONDITIONING REQUIREMENTS AT DEPARTMENT |
|---|
| 12 | 12 | | FACILITIES. The department shall ensure that each cellblock, |
|---|
| 13 | 13 | | dormitory, and common area in a facility operated by the department |
|---|
| 14 | 14 | | is equipped with an air conditioning unit that is operating to |
|---|
| 15 | 15 | | maintain the air temperature at not less than 65 degrees Fahrenheit |
|---|
| 16 | 16 | | or more than 85 degrees Fahrenheit. |
|---|
| 17 | 17 | | SECTION 2. The Texas Department of Criminal Justice is not |
|---|
| 18 | 18 | | required to comply with the requirements of Section 501.028, |
|---|
| 19 | 19 | | Government Code, as added by this Act, unless the legislature |
|---|
| 20 | 20 | | appropriates money specifically for this purpose during the 89th |
|---|
| 21 | 21 | | Texas Legislative Session. If the Legislature does appropriate |
|---|
| 22 | 22 | | money for this purpose during the 89th Texas Legislative Session, |
|---|
| 23 | 23 | | The Texas Department of Criminal Justice is not required to comply |
|---|
| 24 | 24 | | with the requirements of Section 501.028, Government Code, as added |
|---|
| 25 | 25 | | by this Act, until September 1, 2027. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect on the 91st day after the |
|---|
| 27 | 27 | | last day of the legislative session. |
