55 CONCURRENT RESOLUTION
66 WHEREAS, Transnational cartels are exploiting weak and
77 unsecure points along the United States Southern Border to expand
88 their criminal enterprises and terrorize Americans; and
99 WHEREAS, 379 million deadly doses of fentanyl were seized by
1010 U.S. authorities in 2022, enough to kill every American man, woman,
1111 and child; and
1212 WHEREAS, The State of Texas is charged with protecting its
1313 citizens and is empowered to defend itself against invasion under
1414 Article I, Section 10 of the United States Constitution; and
1515 WHEREAS, Article IV, Section 7 of the Texas Constitution
1616 states that the Governor of Texas "shall be Commander-in-Chief of
1717 the military forces of the State" and has the power to organize
1818 armed forces to "repel invasions"; and
1919 WHEREAS, The United States Federal Government is charged, in
2020 the United States Constitution, to "provide for the common defense"
2121 and protect its States "against invasion" under the Preamble and
2222 Article IV, Section 4, respectively; and
2323 WHEREAS, The State of Texas has spent $4 billion on border
2424 initiatives in the 2021-2022 biennium, investing in
2525 state-of-the-art detection equipment, a border wall, and calling up
2626 tens of thousands of members of National and State Guard units; and
2727 WHEREAS, Operation Lone Star's multi-agency effort has led to
2828 over 352,000 illegal immigrant apprehensions and more than 23,000
2929 criminal arrests; and
3030 WHEREAS, Both human and drug trafficking by transnational
3131 cartels have created a security threat and humanitarian disaster by
3232 terrorizing residents of the United States and the State of Texas;
3333 and
3434 WHEREAS, Four United States citizens were kidnapped by a
3535 cartel abroad in early March 2023, two of them brutally murdered;
3636 unfortunately, the tragic incident was not isolated, and violence
3737 permeates any area these transnational cartels inhabit; and
3838 WHEREAS, The continual violation of Texas' sovereignty and
3939 territorial integrity has resulted in reports of residents of Texas
4040 being assaulted, threatened with violence, and robbed; now,
4141 therefore, be it
4242 RESOLVED, That the 88th Legislature of the State of Texas,
4343 3rd Called Session, hereby declare an invasion by transnational
4444 cartel terrorists under Article I, Section 10 of the United States
4545 Constitution and Article IV, Section 7 of the Texas Constitution;
4646 and, be it further
4747 RESOLVED, That the Legislature ask Governor Abbott to
4848 accelerate the construction of a wall along the Southern Border,
4949 utilizing Eminent Domain where necessary, to prevent the entrance
5050 of transnational cartels into the state; and, be it further
5151 RESOLVED, That the Legislature demand that the U.S. Congress
5252 recognize its obligation under the U.S. Constitution to "provide
5353 for the common defense" by voting to deploy U.S. military forces to
5454 combat transnational cartels; and, be it further
5555 RESOLVED, That the Legislature demand that the federal
5656 government allocate more financial support to Texas' border
5757 security wall and reimburse Texas for past expenditures on security
5858 efforts to repel invaders at its Southern Border; and, be it further
5959 RESOLVED, That the Texas Secretary of State forward official
6060 copies of this resolution to the President of the United States, to
6161 the President of the Senate and the Speaker of the House of
6262 Representatives of the United States Congress, and to all members
6363 of the Texas delegation to Congress with the request that this
6464 resolution be officially entered in the Congressional Record as a
6565 memorial to the Congress of the United States of America.
