| 8 | 8 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Article I, Texas Constitution, is amended by |
|---|
| 10 | 10 | | adding Section 37 to read as follows: |
|---|
| 11 | 11 | | Sec. 37. (a) In this section, "parent" means a natural |
|---|
| 12 | 12 | | parent, stepparent, adoptive parent, legal guardian, or other legal |
|---|
| 13 | 13 | | custodian of a child. |
|---|
| 14 | 14 | | (b) A parent has the right to direct the education of the |
|---|
| 15 | 15 | | parent's child, including the right to: |
|---|
| 16 | 16 | | (1) make reasonable choices within the public school |
|---|
| 17 | 17 | | system; |
|---|
| 18 | 18 | | (2) choose an alternative to public education, such as |
|---|
| 19 | 19 | | a private school, including a parochial school or home school; |
|---|
| 20 | 20 | | (3) access and view public school teaching materials, |
|---|
| 21 | 21 | | textbooks and other instructional materials, and library books; |
|---|
| 22 | 22 | | (4) attend meetings of the governing body of a public |
|---|
| 23 | 23 | | school; and |
|---|
| 24 | 24 | | (5) access public school student records for the |
|---|
| 25 | 25 | | parent's child, including the child's student health records. |
|---|
| 26 | 26 | | (c) The rights described by Subsection (b) of this section |
|---|
| 27 | 27 | | may not be denied or restricted because the parent or the child is |
|---|
| 28 | 28 | | an individual with a disability. |
|---|
| 29 | 29 | | (d) The legislature by general law may provide for processes |
|---|
| 30 | 30 | | to ensure that the rights described by Subsection (b) of this |
|---|
| 31 | 31 | | section are upheld. |
|---|
| 32 | 32 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 33 | 33 | | submitted to the voters at an election to be held May 4, 2024. The |
|---|
| 34 | 34 | | ballot shall be printed to permit voting for or against the |
|---|
| 35 | 35 | | proposition: "The constitutional amendment establishing a |
|---|
| 36 | 36 | | parent's right to direct a child's education." |
