| 7 | 7 | | relating to an appropriation to provide funding for the |

| 8 | 8 | | construction, operation, and maintenance of border barrier |
|---|
| 9 | 9 | | infrastructure and border security operations, including funding |
|---|
| 10 | 10 | | for additional overtime expenses and costs due to certain increased |
|---|
| 11 | 11 | | law enforcement presence. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. APPROPRIATION TO TRUSTEED PROGRAMS WITHIN THE |
|---|
| 14 | 14 | | OFFICE OF THE GOVERNOR. (a) The amount of $1,540,000,000 is |
|---|
| 15 | 15 | | appropriated from the general revenue fund to the Trusteed Programs |
|---|
| 16 | 16 | | within the Office of the Governor for use during the two-year period |
|---|
| 17 | 17 | | beginning on the effective date of this Act for the purpose of |
|---|
| 18 | 18 | | providing funding for border security operations and the |
|---|
| 19 | 19 | | construction, operation, and maintenance of border barrier |
|---|
| 20 | 20 | | infrastructure. |
|---|
| 21 | 21 | | (b) Of the amount appropriated by Subsection (a) of this |
|---|
| 22 | 22 | | section, the Trusteed Programs within the Office of the Governor |
|---|
| 23 | 23 | | shall transfer $40,000,000 to the Department of Public Safety for |
|---|
| 24 | 24 | | border security operations, including paying for additional |
|---|
| 25 | 25 | | overtime expenses and costs due to an increased law enforcement |
|---|
| 26 | 26 | | presence to preserve public safety and security in the Colony Ridge |
|---|
| 27 | 27 | | development in Liberty County, Texas. |
|---|
| 28 | 28 | | SECTION 2. PROHIBITIONS ON USE OF APPROPRIATED MONEY. The |
|---|
| 29 | 29 | | money appropriated by this Act may not be used to: |
|---|
| 30 | 30 | | (1) acquire property through the exercise of eminent |
|---|
| 31 | 31 | | domain; |
|---|
| 32 | 32 | | (2) build a barrier along this state's international |
|---|
| 33 | 33 | | border with Mexico on property acquired through the exercise of |
|---|
| 34 | 34 | | eminent domain; |
|---|
| 35 | 35 | | (3) acquire property for a barrier that abuts the |
|---|
| 36 | 36 | | boundary between this state and another state; or |
|---|
| 37 | 37 | | (4) build a barrier that abuts the boundary between |
|---|
| 38 | 38 | | this state and another state. |
|---|
| 39 | 39 | | SECTION 3. EFFECTIVE DATE. This Act takes effect |
|---|
| 40 | 40 | | immediately if it receives a vote of two-thirds of all the members |
|---|
| 41 | 41 | | elected to each house, as provided by Section 39, Article III, Texas |
|---|
| 42 | 42 | | Constitution. If this Act does not receive the vote necessary for |
|---|
| 43 | 43 | | immediate effect, this Act takes effect on the 91st day after the |
|---|
| 44 | 44 | | last day of the legislative session. |
