44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the definition of firearm for purposes of certain
77 criminal offenses.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 46.01(3), Penal Code, is amended to read
1010 as follows:
1111 (3) "Firearm" means any device designed, made, or
1212 adapted to expel a projectile through a barrel by using the energy
1313 generated by an explosion or burning substance or any device
1414 readily convertible to that use. Firearm does not include:
1515 (A) a firearm that may have, as an integral part,
1616 a folding knife blade or other characteristics of weapons made
1717 illegal by this chapter and that is:
1818 (i) [(A)] an antique or curio firearm
1919 manufactured before 1899; or
2020 (ii) [(B)] a replica of an antique or curio
2121 firearm manufactured before 1899, but only if the replica does not
2222 use rim fire or center fire ammunition; or
2323 (B) a less-lethal projectile device.
2424 SECTION 2. Section 46.01, Penal Code, is amended by adding
2525 Subdivision (21) to read as follows:
2626 (21) "Less-lethal projectile device" means any
2727 weapon, device, or munition that is designed, made, or adapted to
2828 expel a projectile or multiple projectiles against a target to
2929 temporarily incapacitate the target while minimizing the risk of
3030 serious bodily injury or death.
3131 SECTION 3. The change in law made by this Act applies only
3232 to an offense committed on or after the effective date of this Act.
3333 An offense committed before the effective date of this Act is
3434 governed by the law in effect on the date the offense was committed,
3535 and the former law is continued in effect for that purpose. For
3636 purposes of this section, an offense was committed before the
3737 effective date of this Act if any element of the offense occurred
3838 before that date.
3939 SECTION 4. This Act takes effect on the 91st day after the
4040 last day of the legislative session.
