6	6	relating to the creation of the Honey Creek Improvement District
7	7	No. 1; providing authority to issue bonds; providing authority to
8	8	impose assessments and fees.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Subtitle C, Title 4, Special District Local Laws
11	11	Code, is amended by adding Chapter 3796 to read as follows:
12	12	CHAPTER 3796. HONEY CREEK IMPROVEMENT DISTRICT NO. 1
13	13	SUBCHAPTER A. GENERAL PROVISIONS
14	14	Sec. 3796.0101. DEFINITIONS. In this chapter:
15	15	(1) "Board" means the district's board of directors.
16	16	(2) "City" means the City of McKinney.
17	17	(3) "Director" means a board member.
18	18	(4) "District" means the Honey Creek Improvement
19	19	District No. 1.
20	20	Sec. 3796.0102. NATURE OF DISTRICT. The Honey Creek
21	21	Improvement District No. 1 is a special district created under
22	22	Section 59, Article XVI, Texas Constitution.
23	23	Sec. 3796.0103. PURPOSE: DECLARATION OF INTENT. (a) The
24	24	creation of the district is essential to accomplish the purposes of
25	25	Sections 52 and 52-a, Article III, and Section 59, Article XVI,
26	26	Texas Constitution, and other public purposes stated in this
27	27	chapter.
28	28	(b) By creating the district and in authorizing the city and
29	29	other political subdivisions to contract with the district, the
30	30	legislature has established a program to accomplish the public
31	31	purposes set out in Section 52-a, Article III, Texas Constitution.
32	32	(c) The creation of the district is necessary to promote,
33	33	develop, encourage, and maintain employment, commerce,
34	34	transportation, housing, tourism, recreation, the arts,
35	35	entertainment, economic development, safety, and the public
36	36	welfare in the district.
37	37	(d) This chapter and the creation of the district may not be
38	38	interpreted to relieve the city from providing the level of
39	39	services provided as of the effective date of the Act enacting this
40	40	chapter to the area in the district. The district is created to
41	41	supplement and not to supplant city services provided in the
42	42	district.
43	43	Sec. 3796.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
44	44	(a) All land and other property included in the district will
45	45	benefit from the improvements and services to be provided by the
46	46	district under powers conferred by Sections 52 and 52-a, Article
47	47	III, and Section 59, Article XVI, Texas Constitution, and other
48	48	powers granted under this chapter.
49	49	(b) The district is created to serve a public use and
50	50	benefit.
51	51	(c) The creation of the district is in the public interest
52	52	and is essential to further the public purposes of:
53	53	(1) developing and diversifying the economy of the
54	54	state;
55	55	(2) eliminating unemployment and underemployment; and
56	56	(3) developing or expanding transportation and
57	57	commerce.
58	58	(d) The district will:
59	59	(1) promote the health, safety, and general welfare of
60	60	residents, employers, potential employees, employees, visitors,
61	61	and consumers in the district, and of the public;
62	62	(2) provide needed funding for the district to
63	63	preserve, maintain, and enhance the economic health and vitality of
64	64	the district territory as a community and business center;
65	65	(3) promote the health, safety, welfare, and enjoyment
66	66	of the public by providing pedestrian ways and by landscaping and
67	67	developing certain areas in the district, which are necessary for
68	68	the restoration, preservation, and enhancement of scenic beauty;
69	69	and
70	70	(4) provide for water, wastewater, drainage, road, and
71	71	recreational facilities for the district.
72	72	(e) Pedestrian ways along or across a street, whether at
73	73	grade or above or below the surface, and street lighting, street
74	74	landscaping, parking, and street art objects are parts of and
75	75	necessary components of a street and are considered to be a street
76	76	or road improvement.
77	77	(f) The district will not act as the agent or
78	78	instrumentality of any private interest even though the district
79	79	will benefit many private interests as well as the public.
80	80	Sec. 3796.0105. INITIAL DISTRICT TERRITORY. (a) The
81	81	district is initially composed of the territory described by
82	82	Section 2 of the Act enacting this chapter.
83	83	(b) The boundaries and field notes contained in Section 2 of
84	84	the Act enacting this chapter form a closure. A mistake in the field
85	85	notes or in copying the field notes in the legislative process does
86	86	not affect the district's:
87	87	(1) organization, existence, or validity;
88	88	(2) right to issue any type of bonds for the purposes
89	89	for which the district is created or to pay the principal of and
90	90	interest on the bonds;
91	91	(3) right to impose or collect an assessment; or
92	92	(4) legality or operation.
93	93	Sec. 3796.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
94	94	All or any part of the area of the district is eligible to be
95	95	included in:
96	96	(1) a tax increment reinvestment zone created under
97	97	Chapter 311, Tax Code; or
98	98	(2) a tax abatement reinvestment zone created under
99	99	Chapter 312, Tax Code.
100	100	Sec. 3796.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT
101	101	DISTRICTS LAW. Except as otherwise provided by this chapter,
102	102	Chapter 375, Local Government Code, applies to the district.
103	103	Sec. 3796.0108. PRECONDITION. (a) The district may not
104	104	exercise any powers granted to the district by this chapter or other
105	105	law unless a development agreement between the city and the primary
106	106	landowner in the district that establishes the standards that apply
107	107	to development in the district, in addition to those contained in
108	108	zoning, subdivision, and other applicable ordinances of the city,
109	109	has been executed.
110	110	(b) If a development agreement described by Subsection (a)
111	111	has not been executed before September 1, 2024, the board shall
112	112	dissolve the district in the manner provided by Subchapter I as soon
113	113	as possible after September 1, 2024.
114	114	Sec. 3796.0109. CONSTRUCTION OF CHAPTER. This chapter
115	115	shall be liberally construed in conformity with the findings and
116	116	purposes stated in this chapter.
117	117	SUBCHAPTER B. BOARD OF DIRECTORS
118	118	Sec. 3796.0201. GOVERNING BODY; TERMS. (a) The district is
119	119	governed by a board of five elected directors who serve staggered
120	120	terms of four years.
121	121	(b) Directors are elected in the manner provided by
122	122	Subchapter D, Chapter 49, Water Code.
123	123	Sec. 3796.0202. COMPENSATION; EXPENSES. (a) The district
124	124	may compensate each director in an amount not to exceed $150 for
125	125	each board meeting. The total amount of compensation for each
126	126	director in one year may not exceed $7,200.
127	127	(b) A director is entitled to reimbursement for necessary
128	128	and reasonable expenses incurred in carrying out the duties and
129	129	responsibilities of the board.
130	130	Sec. 3796.0203. INITIAL DIRECTORS. (a) The initial board
131	131	consists of the following directors:

144	144	(b) Of the initial directors, the terms of directors
145	145	appointed for positions one through three expire June 1, 2025, and
146	146	the terms of directors appointed for positions four and five expire
147	147	June 1, 2027.
148	148	SUBCHAPTER C. POWERS AND DUTIES
149	149	Sec. 3796.0301. GENERAL POWERS AND DUTIES. The district
150	150	has the powers and duties necessary to accomplish the purposes for
151	151	which the district is created.
152	152	Sec. 3796.0302. IMPROVEMENT PROJECTS AND SERVICES. (a)
153	153	The district, using any money available to the district for the
154	154	purpose, may provide, design, construct, acquire, improve,
155	155	relocate, operate, maintain, or finance an improvement project or
156	156	service authorized under a development agreement described by
157	157	Section 3796.0108, under this chapter, or under Chapter 375, Local
158	158	Government Code.
159	159	(b) The district may contract with a governmental or private
160	160	entity to carry out an action under Subsection (a).
161	161	(c) The implementation of a district project or service is a
162	162	governmental function or service for the purposes of Chapter 791,
163	163	Government Code.
164	164	Sec. 3796.0303. NONPROFIT CORPORATION. (a) The board by
165	165	resolution may authorize the creation of a nonprofit corporation to
166	166	assist and act for the district in implementing a project or
167	167	providing a service authorized by this chapter.
168	168	(b) The nonprofit corporation:
169	169	(1) has each power of and is considered to be a local
170	170	government corporation created under Subchapter D, Chapter 431,
171	171	Transportation Code; and
172	172	(2) may implement any project and provide any service
173	173	authorized by this chapter.
174	174	(c) The board shall appoint the board of directors of the
175	175	nonprofit corporation. The board of directors of the nonprofit
176	176	corporation shall serve in the same manner as the board of directors
177	177	of a local government corporation created under Subchapter D,
178	178	Chapter 431, Transportation Code, except that a board member is not
179	179	required to reside in the district.
180	180	Sec. 3796.0304. MEMBERSHIP IN CHARITABLE ORGANIZATIONS.
181	181	The district may join and pay dues to a charitable or nonprofit
182	182	organization that performs a service or provides an activity
183	183	consistent with the furtherance of a district purpose.
184	184	Sec. 3796.0305. PARKING FACILITIES. (a) The district may
185	185	acquire, lease as lessor or lessee, construct, develop, own,
186	186	operate, and maintain parking facilities or a system of parking
187	187	facilities, including lots, garages, parking terminals, or other
188	188	structures or accommodations for parking motor vehicles off the
189	189	streets and related appurtenances.
190	190	(b) The district's parking facilities serve the public
191	191	purposes of the district and are owned, used, and held for a public
192	192	purpose even if leased or operated by a private entity for a term of
193	193	years.
194	194	(c) The district's parking facilities are parts of and
195	195	necessary components of a street and are considered to be a street
196	196	or road improvement.
197	197	(d) The development and operation of the district's parking
198	198	facilities may be considered an economic development program.
199	199	Sec. 3796.0306. ADDING OR EXCLUDING LAND. (a) Subject to
200	200	Subsection (b), the district may add or exclude land in the manner
201	201	provided by Subchapter J, Chapter 49, Water Code, or by Subchapter
202	202	H, Chapter 54, Water Code.
203	203	(b) The district may add territory as described by
204	204	Subsection (a) only if the governing body of the city by ordinance
205	205	or resolution consents to the addition.
206	206	Sec. 3796.0307. DISBURSEMENTS AND TRANSFERS OF MONEY. The
207	207	board by resolution shall establish the number of directors'
208	208	signatures and the procedure required for a disbursement or
209	209	transfer of district money.
210	210	Sec. 3796.0308. DIVISION OF DISTRICT. (a) The district may
211	211	be divided into two or more new districts only if the district:
212	212	(1) has no outstanding bonded debt; and
213	213	(2) is not imposing ad valorem taxes.
214	214	(b) This chapter applies to any new district created by the
215	215	division of the district, and a new district has all the powers and
216	216	duties of the district.
217	217	(c) Any new district created by the division of the district
218	218	may not, at the time the new district is created, contain any land
219	219	outside the area described by Section 2 of the Act enacting this
220	220	chapter.
221	221	(d) The board, on its own motion or on receipt of a petition
222	222	signed by the owner or owners of a majority of the assessed value of
223	223	the real property in the district, may adopt an order dividing the
224	224	district.
225	225	(e) An order dividing the district must:
226	226	(1) name each new district;
227	227	(2) include the metes and bounds description of the
228	228	territory of each new district;
229	229	(3) appoint initial directors for each new district;
230	230	and
231	231	(4) provide for the division of assets and liabilities
232	232	between or among the new districts.
233	233	(f) On or before the 30th day after the date of adoption of
234	234	an order dividing the district, the district shall file the order
235	235	with the Texas Commission on Environmental Quality and record the
236	236	order in the real property records of each county in which the
237	237	district is located.
238	238	(g) Municipal consent to the creation of the district and to
239	239	the inclusion of land in the district granted under Section
240	240	3796.0503 acts as municipal consent to the creation of any new
241	241	district created by the division of the district and to the
242	242	inclusion of land in the new district.
243	243	Sec. 3796.0309. CERTAIN RESIDENTIAL PROPERTY NOT EXEMPT.
244	244	Section 375.161, Local Government Code, does not apply to the
245	245	district.
246	246	Sec. 3796.0310. NO AD VALOREM TAX. The district may not
247	247	impose an ad valorem tax.
248	248	Sec. 3796.0311. NO EMINENT DOMAIN POWER. The district may
249	249	not exercise the power of eminent domain.
250	250	SUBCHAPTER D. ASSESSMENTS
251	251	Sec. 3796.0401. PETITION REQUIRED FOR FINANCING SERVICES
252	252	AND IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
253	253	service or improvement project with assessments under this chapter
254	254	unless a written petition requesting that service or improvement
255	255	has been filed with the board.
256	256	(b) A petition filed under Subsection (a) must be signed by
257	257	the owners of a majority of the assessed value of real property in
258	258	the district subject to assessment according to the most recent
259	259	certified tax appraisal roll for the county.
260	260	Sec. 3796.0402. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
261	261	The board by resolution may impose and collect an assessment for any
262	262	purpose authorized by this chapter in all or any part of the
263	263	district.
264	264	(b) An assessment, a reassessment, or an assessment
265	265	resulting from an addition to or correction of the assessment roll
266	266	by the district, penalties and interest on an assessment or
267	267	reassessment, an expense of collection, and reasonable attorney's
268	268	fees incurred by the district:
269	269	(1) are a first and prior lien against the property
270	270	assessed;
271	271	(2) are superior to any other lien or claim other than
272	272	a lien or claim for county, school district, or municipal ad valorem
273	273	taxes; and
274	274	(3) are the personal liability of and a charge against
275	275	the owners of the property even if the owners are not named in the
276	276	assessment proceedings.
277	277	(c) The lien is effective from the date of the board's
278	278	resolution imposing the assessment until the date the assessment is
279	279	paid. The board may enforce the lien in the same manner that a
280	280	taxing unit, as that term is defined by Section 1.04, Tax Code, may
281	281	enforce an ad valorem tax lien against real property.
282	282	(d) The board may make a correction to or deletion from the
283	283	assessment roll that does not increase the amount of assessment of
284	284	any parcel of land without providing notice and holding a hearing in
285	285	the manner required for additional assessments.
286	286	SUBCHAPTER E. BONDS
287	287	Sec. 3796.0501. AUTHORITY TO BORROW MONEY AND TO ISSUE
288	288	BONDS AND OTHER OBLIGATIONS. (a) The district may borrow money on
289	289	terms determined by the board.
290	290	(b) The district may issue, by public or private sale,
291	291	bonds, notes, or other obligations payable wholly or partly from
292	292	assessments, revenue, contract payments, grants, or other district
293	293	money, or any combination of those sources of money, to pay for any
294	294	authorized district purpose.
295	295	(c) The district may issue, by public or private sale,
296	296	bonds, notes, or other obligations payable wholly or partly from
297	297	assessments in the manner provided by Subchapter A, Chapter 372,
298	298	Local Government Code, if the improvement financed by the
299	299	obligation issued under this section will be conveyed to or
300	300	operated and maintained by a municipality or other retail utility
301	301	provider pursuant to an agreement with the district entered into
302	302	before the issuance of the obligation.
303	303	Sec. 3796.0502. BONDS SECURED BY REVENUE OR CONTRACT
304	304	PAYMENTS. The district may issue, without an election, bonds
305	305	secured by:
306	306	(1) revenue other than ad valorem taxes, including
307	307	contract revenues; or
308	308	(2) contract payments, provided that the requirements
309	309	of Section 49.108, Water Code, have been met.
310	310	Sec. 3796.0503. CONSENT OF CITY REQUIRED. The board may not
311	311	issue bonds until the city has consented by ordinance or resolution
312	312	to the creation of the district and to the inclusion of land in the
313	313	district.
314	314	SUBCHAPTER I. DISSOLUTION
315	315	Sec. 3796.0901. DISSOLUTION. (a) The board shall dissolve
316	316	the district on written petition filed with the board by the owners
317	317	of:
318	318	(1) 66 percent or more of the assessed value subject to
319	319	assessment by the district of the property in the district based on
320	320	the most recent certified county property tax rolls; or
321	321	(2) 66 percent or more of the surface area of the
322	322	district, excluding roads, streets, highways, utility
323	323	rights-of-way, other public areas, and other property exempt from
324	324	assessment by the district according to the most recent certified
325	325	county property tax rolls.
326	326	(b) The district may not be dissolved if the district:
327	327	(1) has any outstanding bonded or other indebtedness
328	328	until that bonded or other indebtedness has been repaid or defeased
329	329	in accordance with the order or resolution authorizing the issuance
330	330	of the bonded or other indebtedness;
331	331	(2) has a contractual obligation to pay money until
332	332	that obligation has been fully paid in accordance with the
333	333	contract; or
334	334	(3) owns, operates, or maintains public works,
335	335	facilities, or improvements unless the district has contracted with
336	336	another party for the ownership and operation or maintenance of the
337	337	public works, facilities, or improvements.
338	338	(c) Section 375.262, Local Government Code, does not apply
339	339	to the district.
340	340	SECTION 2. The Honey Creek Improvement District No. 1
341	341	initially includes all territory contained in the following area:

345	345	BEING a 1218.714 acre tract of land situated in the in the L.D.
346	346	Davidson Survey, Abstract No. 285, the E. Hamilton Survey, Abstract
347	347	No. 372, the W.H. Horn Survey, Abstract No. 1070, the W.M. Rice
348	348	Survey, Abstract No. 770, and the Meredith Hart Survey, Abstract
349	349	No. 371, City of McKinney, Collin County, Texas, and being the
350	350	remainder of a 189.1 acre tract and 1064.2 acre tract of land
351	351	described in a deed to Franklin Family Partnership recorded in
352	352	Volume 5540, Page 826, Land Records, Collin County, Texas, and
353	353	being part of a 3.00 acre tract of land described in a deed to Lela
354	354	M. Fryar recorded in Volume 703, Page 617, Land Records, Collin
355	355	County, Texas, and being all of a 10.00 acre tract of land described
356	356	in a deed to Richard Loren Franklin recorded in Clerk File
357	357	No. 95-0015568 Land Records, Collin County, Texas, and being more
358	358	particularly described as follows:
359	359	COMMENCING at a railroad spike found in asphalt at the intersection
360	360	of the centerline of County Road 166 and County Road 168, said point
361	361	being the apparent intersection of four surveys: the southeast
362	362	corner of the Thomas E. Pelham Survey, Abstract Number 724, the
363	363	southwest corner of the Jno. Cahill Survey, Abstract number 143,
364	364	the northeast corner of said D. J. Franklin Survey, and the
365	365	northwest corner of said L. D. Davidson Survey;
