99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1111 Code, is amended by adding Chapter 3796 to read as follows:
1212 CHAPTER 3796. HONEY CREEK IMPROVEMENT DISTRICT NO. 1
1313 SUBCHAPTER A. GENERAL PROVISIONS
1414 Sec. 3796.0101. DEFINITIONS. In this chapter:
1515 (1) "Board" means the district's board of directors.
1616 (2) "City" means the City of McKinney.
1717 (3) "Director" means a board member.
1818 (4) "District" means the Honey Creek Improvement
1919 District No. 1.
2020 Sec. 3796.0102. NATURE OF DISTRICT. The Honey Creek
2121 Improvement District No. 1 is a special district created under
2222 Section 59, Article XVI, Texas Constitution.
2323 Sec. 3796.0103. PURPOSE: DECLARATION OF INTENT. (a) The
2424 creation of the district is essential to accomplish the purposes of
2525 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
2626 Texas Constitution, and other public purposes stated in this
2727 chapter.
2828 (b) By creating the district and in authorizing the city and
2929 other political subdivisions to contract with the district, the
3030 legislature has established a program to accomplish the public
3131 purposes set out in Section 52-a, Article III, Texas Constitution.
3232 (c) The creation of the district is necessary to promote,
3333 develop, encourage, and maintain employment, commerce,
3434 transportation, housing, tourism, recreation, the arts,
3535 entertainment, economic development, safety, and the public
3636 welfare in the district.
3737 (d) This chapter and the creation of the district may not be
3838 interpreted to relieve the city from providing the level of
3939 services provided as of the effective date of the Act enacting this
4040 chapter to the area in the district. The district is created to
4141 supplement and not to supplant city services provided in the
4242 district.
4343 Sec. 3796.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
4444 (a) All land and other property included in the district will
4545 benefit from the improvements and services to be provided by the
4646 district under powers conferred by Sections 52 and 52-a, Article
4747 III, and Section 59, Article XVI, Texas Constitution, and other
4848 powers granted under this chapter.
4949 (b) The district is created to serve a public use and
5050 benefit.
5151 (c) The creation of the district is in the public interest
5252 and is essential to further the public purposes of:
5353 (1) developing and diversifying the economy of the
5454 state;
5555 (2) eliminating unemployment and underemployment; and
5656 (3) developing or expanding transportation and
5757 commerce.
5858 (d) The district will:
5959 (1) promote the health, safety, and general welfare of
6060 residents, employers, potential employees, employees, visitors,
6161 and consumers in the district, and of the public;
6262 (2) provide needed funding for the district to
6363 preserve, maintain, and enhance the economic health and vitality of
6464 the district territory as a community and business center;
6565 (3) promote the health, safety, welfare, and enjoyment
6666 of the public by providing pedestrian ways and by landscaping and
6767 developing certain areas in the district, which are necessary for
6868 the restoration, preservation, and enhancement of scenic beauty;
6969 and
7070 (4) provide for water, wastewater, drainage, road, and
7171 recreational facilities for the district.
7272 (e) Pedestrian ways along or across a street, whether at
7373 grade or above or below the surface, and street lighting, street
7474 landscaping, parking, and street art objects are parts of and
7575 necessary components of a street and are considered to be a street
7676 or road improvement.
7777 (f) The district will not act as the agent or
7878 instrumentality of any private interest even though the district
7979 will benefit many private interests as well as the public.
8080 Sec. 3796.0105. INITIAL DISTRICT TERRITORY. (a) The
8181 district is initially composed of the territory described by
8282 Section 2 of the Act enacting this chapter.
8383 (b) The boundaries and field notes contained in Section 2 of
8484 the Act enacting this chapter form a closure. A mistake in the field
8585 notes or in copying the field notes in the legislative process does
8686 not affect the district's:
8787 (1) organization, existence, or validity;
8888 (2) right to issue any type of bonds for the purposes
8989 for which the district is created or to pay the principal of and
9090 interest on the bonds;
9191 (3) right to impose or collect an assessment; or
9292 (4) legality or operation.
9393 Sec. 3796.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
9494 All or any part of the area of the district is eligible to be
9595 included in:
9696 (1) a tax increment reinvestment zone created under
9797 Chapter 311, Tax Code; or
9898 (2) a tax abatement reinvestment zone created under
9999 Chapter 312, Tax Code.
100100 Sec. 3796.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT
101101 DISTRICTS LAW. Except as otherwise provided by this chapter,
102102 Chapter 375, Local Government Code, applies to the district.
103103 Sec. 3796.0108. PRECONDITION. (a) The district may not
104104 exercise any powers granted to the district by this chapter or other
105105 law unless a development agreement between the city and the primary
106106 landowner in the district that establishes the standards that apply
107107 to development in the district, in addition to those contained in
108108 zoning, subdivision, and other applicable ordinances of the city,
109109 has been executed.
110110 (b) If a development agreement described by Subsection (a)
111111 has not been executed before September 1, 2024, the board shall
112112 dissolve the district in the manner provided by Subchapter I as soon
113113 as possible after September 1, 2024.
114114 Sec. 3796.0109. CONSTRUCTION OF CHAPTER. This chapter
115115 shall be liberally construed in conformity with the findings and
116116 purposes stated in this chapter.
117117 SUBCHAPTER B. BOARD OF DIRECTORS
118118 Sec. 3796.0201. GOVERNING BODY; TERMS. (a) The district is
119119 governed by a board of five elected directors who serve staggered
120120 terms of four years.
121121 (b) Directors are elected in the manner provided by
122122 Subchapter D, Chapter 49, Water Code.
123123 Sec. 3796.0202. COMPENSATION; EXPENSES. (a) The district
124124 may compensate each director in an amount not to exceed $150 for
125125 each board meeting. The total amount of compensation for each
126126 director in one year may not exceed $7,200.
127127 (b) A director is entitled to reimbursement for necessary
128128 and reasonable expenses incurred in carrying out the duties and
129129 responsibilities of the board.
130130 Sec. 3796.0203. INITIAL DIRECTORS. (a) The initial board
131131 consists of the following directors:

144144 (b) Of the initial directors, the terms of directors
145145 appointed for positions one through three expire June 1, 2025, and
146146 the terms of directors appointed for positions four and five expire
147147 June 1, 2027.
148148 SUBCHAPTER C. POWERS AND DUTIES
149149 Sec. 3796.0301. GENERAL POWERS AND DUTIES. The district
150150 has the powers and duties necessary to accomplish the purposes for
151151 which the district is created.
152152 Sec. 3796.0302. IMPROVEMENT PROJECTS AND SERVICES. (a)
153153 The district, using any money available to the district for the
154154 purpose, may provide, design, construct, acquire, improve,
155155 relocate, operate, maintain, or finance an improvement project or
156156 service authorized under a development agreement described by
157157 Section 3796.0108, under this chapter, or under Chapter 375, Local
158158 Government Code.
159159 (b) The district may contract with a governmental or private
160160 entity to carry out an action under Subsection (a).
161161 (c) The implementation of a district project or service is a
162162 governmental function or service for the purposes of Chapter 791,
163163 Government Code.
164164 Sec. 3796.0303. NONPROFIT CORPORATION. (a) The board by
165165 resolution may authorize the creation of a nonprofit corporation to
166166 assist and act for the district in implementing a project or
167167 providing a service authorized by this chapter.
168168 (b) The nonprofit corporation:
169169 (1) has each power of and is considered to be a local
170170 government corporation created under Subchapter D, Chapter 431,
171171 Transportation Code; and
172172 (2) may implement any project and provide any service
173173 authorized by this chapter.
174174 (c) The board shall appoint the board of directors of the
175175 nonprofit corporation. The board of directors of the nonprofit
176176 corporation shall serve in the same manner as the board of directors
177177 of a local government corporation created under Subchapter D,
178178 Chapter 431, Transportation Code, except that a board member is not
179179 required to reside in the district.
180180 Sec. 3796.0304. MEMBERSHIP IN CHARITABLE ORGANIZATIONS.
181181 The district may join and pay dues to a charitable or nonprofit
182182 organization that performs a service or provides an activity
183183 consistent with the furtherance of a district purpose.
184184 Sec. 3796.0305. PARKING FACILITIES. (a) The district may
185185 acquire, lease as lessor or lessee, construct, develop, own,
186186 operate, and maintain parking facilities or a system of parking
187187 facilities, including lots, garages, parking terminals, or other
188188 structures or accommodations for parking motor vehicles off the
189189 streets and related appurtenances.
190190 (b) The district's parking facilities serve the public
191191 purposes of the district and are owned, used, and held for a public
192192 purpose even if leased or operated by a private entity for a term of
193193 years.
194194 (c) The district's parking facilities are parts of and
195195 necessary components of a street and are considered to be a street
196196 or road improvement.
197197 (d) The development and operation of the district's parking
198198 facilities may be considered an economic development program.
199199 Sec. 3796.0306. ADDING OR EXCLUDING LAND. (a) Subject to
200200 Subsection (b), the district may add or exclude land in the manner
201201 provided by Subchapter J, Chapter 49, Water Code, or by Subchapter
202202 H, Chapter 54, Water Code.
203203 (b) The district may add territory as described by
204204 Subsection (a) only if the governing body of the city by ordinance
205205 or resolution consents to the addition.
206206 Sec. 3796.0307. DISBURSEMENTS AND TRANSFERS OF MONEY. The
207207 board by resolution shall establish the number of directors'
208208 signatures and the procedure required for a disbursement or
209209 transfer of district money.
210210 Sec. 3796.0308. DIVISION OF DISTRICT. (a) The district may
211211 be divided into two or more new districts only if the district:
212212 (1) has no outstanding bonded debt; and
213213 (2) is not imposing ad valorem taxes.
214214 (b) This chapter applies to any new district created by the
215215 division of the district, and a new district has all the powers and
216216 duties of the district.
217217 (c) Any new district created by the division of the district
218218 may not, at the time the new district is created, contain any land
219219 outside the area described by Section 2 of the Act enacting this
220220 chapter.
221221 (d) The board, on its own motion or on receipt of a petition
222222 signed by the owner or owners of a majority of the assessed value of
223223 the real property in the district, may adopt an order dividing the
224224 district.
225225 (e) An order dividing the district must:
226226 (1) name each new district;
227227 (2) include the metes and bounds description of the
228228 territory of each new district;
229229 (3) appoint initial directors for each new district;
230230 and
231231 (4) provide for the division of assets and liabilities
232232 between or among the new districts.
233233 (f) On or before the 30th day after the date of adoption of
234234 an order dividing the district, the district shall file the order
235235 with the Texas Commission on Environmental Quality and record the
236236 order in the real property records of each county in which the
237237 district is located.
238238 (g) Municipal consent to the creation of the district and to
239239 the inclusion of land in the district granted under Section
240240 3796.0503 acts as municipal consent to the creation of any new
241241 district created by the division of the district and to the
242242 inclusion of land in the new district.
243243 Sec. 3796.0309. CERTAIN RESIDENTIAL PROPERTY NOT EXEMPT.
244244 Section 375.161, Local Government Code, does not apply to the
245245 district.
246246 Sec. 3796.0310. NO AD VALOREM TAX. The district may not
247247 impose an ad valorem tax.
248248 Sec. 3796.0311. NO EMINENT DOMAIN POWER. The district may
249249 not exercise the power of eminent domain.
250250 SUBCHAPTER D. ASSESSMENTS
251251 Sec. 3796.0401. PETITION REQUIRED FOR FINANCING SERVICES
252252 AND IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
253253 service or improvement project with assessments under this chapter
254254 unless a written petition requesting that service or improvement
255255 has been filed with the board.
256256 (b) A petition filed under Subsection (a) must be signed by
257257 the owners of a majority of the assessed value of real property in
258258 the district subject to assessment according to the most recent
259259 certified tax appraisal roll for the county.
260260 Sec. 3796.0402. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
261261 The board by resolution may impose and collect an assessment for any
262262 purpose authorized by this chapter in all or any part of the
263263 district.
264264 (b) An assessment, a reassessment, or an assessment
265265 resulting from an addition to or correction of the assessment roll
266266 by the district, penalties and interest on an assessment or
267267 reassessment, an expense of collection, and reasonable attorney's
268268 fees incurred by the district:
269269 (1) are a first and prior lien against the property
270270 assessed;
271271 (2) are superior to any other lien or claim other than
272272 a lien or claim for county, school district, or municipal ad valorem
273273 taxes; and
274274 (3) are the personal liability of and a charge against
275275 the owners of the property even if the owners are not named in the
276276 assessment proceedings.
277277 (c) The lien is effective from the date of the board's
278278 resolution imposing the assessment until the date the assessment is
279279 paid. The board may enforce the lien in the same manner that a
280280 taxing unit, as that term is defined by Section 1.04, Tax Code, may
281281 enforce an ad valorem tax lien against real property.
282282 (d) The board may make a correction to or deletion from the
283283 assessment roll that does not increase the amount of assessment of
284284 any parcel of land without providing notice and holding a hearing in
285285 the manner required for additional assessments.
286286 SUBCHAPTER E. BONDS
287287 Sec. 3796.0501. AUTHORITY TO BORROW MONEY AND TO ISSUE
288288 BONDS AND OTHER OBLIGATIONS. (a) The district may borrow money on
289289 terms determined by the board.
290290 (b) The district may issue, by public or private sale,
291291 bonds, notes, or other obligations payable wholly or partly from
292292 assessments, revenue, contract payments, grants, or other district
293293 money, or any combination of those sources of money, to pay for any
294294 authorized district purpose.
295295 (c) The district may issue, by public or private sale,
296296 bonds, notes, or other obligations payable wholly or partly from
297297 assessments in the manner provided by Subchapter A, Chapter 372,
298298 Local Government Code, if the improvement financed by the
299299 obligation issued under this section will be conveyed to or
300300 operated and maintained by a municipality or other retail utility
301301 provider pursuant to an agreement with the district entered into
302302 before the issuance of the obligation.
303303 Sec. 3796.0502. BONDS SECURED BY REVENUE OR CONTRACT
304304 PAYMENTS. The district may issue, without an election, bonds
305305 secured by:
306306 (1) revenue other than ad valorem taxes, including
307307 contract revenues; or
308308 (2) contract payments, provided that the requirements
309309 of Section 49.108, Water Code, have been met.
310310 Sec. 3796.0503. CONSENT OF CITY REQUIRED. The board may not
311311 issue bonds until the city has consented by ordinance or resolution
312312 to the creation of the district and to the inclusion of land in the
313313 district.
314314 SUBCHAPTER I. DISSOLUTION
315315 Sec. 3796.0901. DISSOLUTION. (a) The board shall dissolve
316316 the district on written petition filed with the board by the owners
317317 of:
318318 (1) 66 percent or more of the assessed value subject to
319319 assessment by the district of the property in the district based on
320320 the most recent certified county property tax rolls; or
321321 (2) 66 percent or more of the surface area of the
322322 district, excluding roads, streets, highways, utility
323323 rights-of-way, other public areas, and other property exempt from
324324 assessment by the district according to the most recent certified
325325 county property tax rolls.
326326 (b) The district may not be dissolved if the district:
327327 (1) has any outstanding bonded or other indebtedness
328328 until that bonded or other indebtedness has been repaid or defeased
329329 in accordance with the order or resolution authorizing the issuance
330330 of the bonded or other indebtedness;
331331 (2) has a contractual obligation to pay money until
332332 that obligation has been fully paid in accordance with the
333333 contract; or
334334 (3) owns, operates, or maintains public works,
335335 facilities, or improvements unless the district has contracted with
336336 another party for the ownership and operation or maintenance of the
337337 public works, facilities, or improvements.
338338 (c) Section 375.262, Local Government Code, does not apply
339339 to the district.
340340 SECTION 2. The Honey Creek Improvement District No. 1
341341 initially includes all territory contained in the following area:

14671467 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
14681468 Government Code.
14691469 (b) The governor, one of the required recipients, has
14701470 submitted the notice and Act to the Texas Commission on
14711471 Environmental Quality.
14721472 (c) The Texas Commission on Environmental Quality has filed
14731473 its recommendations relating to this Act with the governor,
14741474 lieutenant governor, and speaker of the house of representatives

14761476 (d) All requirements of the constitution and laws of this
14771477 state and the rules and procedures of the legislature with respect

14801480 SECTION 4. This Act takes effect immediately if it receives
14811481 a vote of two-thirds of all the members elected to each house, as
14821482 provided by Section 39, Article III, Texas Constitution. If this
14831483 Act does not receive the vote necessary for immediate effect, this
14841484 Act takes effect September 1, 2023.
