| 6 | 6 | | relating to the enforcement of certain federal laws regulating gas |

| 7 | 7 | | appliance, vehicle, and tool usage within the State of Texas. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter B, Chapter 382, Health and Safety |
|---|
| 10 | 10 | | Code, is amended by adding Section 382.042 to read as follows: |
|---|
| 11 | 11 | | Sec. 382.042. ENFORCEMENT OF CERTAIN FEDERAL LAWS |
|---|
| 12 | 12 | | REGULATING GAS APPLIANCE, VEHICLE, AND TOOL USAGE. (a) An agency |
|---|
| 13 | 13 | | of this state or a person employed by an agency of this state may not |
|---|
| 14 | 14 | | contract with or in any other manner provide assistance to a federal |
|---|
| 15 | 15 | | agency or official with respect to the enforcement of a federal |
|---|
| 16 | 16 | | statute, order, rule, or regulation purporting to regulate gas |
|---|
| 17 | 17 | | appliance, vehicle, or tool usage if the statute, order, rule, or |
|---|
| 18 | 18 | | regulation imposes a prohibition, restriction, or other regulation |
|---|
| 19 | 19 | | that does not exist under the laws of this state. |
|---|
| 20 | 20 | | (b) The attorney general shall defend any agency of this |
|---|
| 21 | 21 | | state that the federal government attempts to sue for an action or |
|---|
| 22 | 22 | | omission consistent with the requirements of this section. |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect on the 91st day after the last day of legislative |
|---|
| 28 | 28 | | session |
