44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the enforcement of certain federal laws regulating gas
77 appliance, vehicle, and tool usage within the State of Texas.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 382, Health and Safety
1010 Code, is amended by adding Section 382.042 to read as follows:
1111 Sec. 382.042. ENFORCEMENT OF CERTAIN FEDERAL LAWS
1212 REGULATING GAS APPLIANCE, VEHICLE, AND TOOL USAGE. (a) An agency
1313 of this state or a person employed by an agency of this state may not
1414 contract with or in any other manner provide assistance to a federal
1515 agency or official with respect to the enforcement of a federal
1616 statute, order, rule, or regulation purporting to regulate gas
1717 appliance, vehicle, or tool usage if the statute, order, rule, or
1818 regulation imposes a prohibition, restriction, or other regulation
1919 that does not exist under the laws of this state.
2020 (b) The attorney general shall defend any agency of this
2121 state that the federal government attempts to sue for an action or
2222 omission consistent with the requirements of this section.
2323 SECTION 2. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect on the 91st day after the last day of legislative
2828 session
