55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the public school accountability system and the career
88 and technology allotment under the Foundation School Program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.053(c), Education Code, is amended to
1111 read as follows:
1212 (c) School districts and campuses must be evaluated based on
1313 three domains of indicators of achievement adopted under this
1414 section that include:
1515 (1) in the student achievement domain, indicators of
1616 student achievement that must include:
1717 (A) for evaluating the performance of districts
1818 and campuses generally:
1919 (i) an indicator that accounts for the
2020 results of assessment instruments required under Sections
2121 39.023(a), (c), and (l), as applicable for the district and campus,
2222 including the results of assessment instruments required for
2323 graduation retaken by a student, aggregated across grade levels by
2424 subject area, including:
2525 (a) for the performance standard
2626 determined by the commissioner under Section 39.0241(a), the
2727 percentage of students who performed satisfactorily on the
2828 assessment instruments, aggregated across grade levels by subject
2929 area; and
3030 (b) for the college readiness
3131 performance standard as determined under Section 39.0241, the
3232 percentage of students who performed satisfactorily on the
3333 assessment instruments, aggregated across grade levels by subject
3434 area; and
3535 (ii) an indicator that accounts for the
3636 results of assessment instruments required under Section
3737 39.023(b), as applicable for the district and campus, including the
3838 percentage of students who performed satisfactorily on the
3939 assessment instruments, as determined by the performance standard
4040 adopted by the agency, aggregated across grade levels by subject
4141 area; and
4242 (B) for evaluating the performance of high school
4343 campuses and districts that include high school campuses,
4444 indicators that account for:
4545 (i) students who satisfy the Texas Success
4646 Initiative (TSI) college readiness benchmarks prescribed by the
4747 Texas Higher Education Coordinating Board under Section 51.334 on
4848 an assessment instrument in reading or mathematics designated by
4949 the coordinating board under that section;
5050 (ii) students who satisfy relevant
5151 performance standards on advanced placement tests or similar
5252 assessments;
5353 (iii) students who earn dual course credits
5454 in the dual credit courses;
5555 (iv) students who enlist in the armed
5656 forces of the United States or the Texas National Guard;
5757 (v) students who earn industry
5858 certifications;
5959 (vi) students admitted into postsecondary
6060 industry certification programs that require as a prerequisite for
6161 entrance successful performance at the secondary level;
6262 (vii) students whose successful completion
6363 of a course or courses under Section 28.014 indicates the student's
6464 preparation to enroll and succeed, without remediation, in an
6565 entry-level general education course for a baccalaureate degree or
6666 associate degree;
6767 (viii) students who successfully met
6868 standards on a composite of indicators that through research
6969 indicates the student's preparation to enroll and succeed, without
7070 remediation, in an entry-level general education course for a
7171 baccalaureate degree or associate degree;
7272 (ix) high school graduation rates, computed
7373 in accordance with standards and definitions adopted in compliance
7474 with the Every Student Succeeds Act (20 U.S.C. Section 6301 et seq.)
7575 subject to the exclusions provided by Subsections (g), (g-1),
7676 (g-2), (g-3), and (g-4);
7777 (x) students who successfully completed an
7878 OnRamps dual enrollment course;
7979 (xi) students who successfully completed a
8080 practicum or internship approved by the State Board of Education;
8181 (xii) students who are awarded an associate
8282 degree; [and]
8383 (xiii) students who successfully completed
8484 a program of study in career and technical education; and
8585 (xiv) students who successfully completed a
8686 Pathways in Technology Early College High School (P-TECH) program
8787 established under Subchapter N, Chapter 29, or another early
8888 college high school program;
8989 (2) in the school progress domain, indicators for
9090 effectiveness in promoting student learning, which must include:
9191 (A) for assessment instruments, including
9292 assessment instruments under Subdivisions (1)(A)(i) and (ii), the
9393 percentage of students who met the standard for improvement, as
9494 determined by the commissioner; and
9595 (B) for evaluating relative performance, the
9696 performance of districts and campuses compared to similar districts
9797 or campuses; and
9898 (3) in the closing the gaps domain, the use of
9999 disaggregated data to demonstrate the differentials among students
100100 from different racial and ethnic groups, socioeconomic
101101 backgrounds, and other factors, including:
102102 (A) students formerly receiving special
103103 education services;
104104 (B) students continuously enrolled; and
105105 (C) students who are mobile.
106106 SECTION 2. Section 39.0544(a), Education Code, is amended
107107 to read as follows:
108108 (a) The commissioner shall adopt rules regarding the
109109 assignment of campus performance ratings by school districts and
110110 open-enrollment charter schools. The rules:
111111 (1) must require a district or school, in assigning an
112112 overall performance rating for a campus, to incorporate:
113113 (A) domain performance ratings assigned by the
114114 commissioner under Section 39.054; [and]
115115 (B) performance ratings based on locally
116116 developed domains or sets of accountability measures; and
117117 (C) any distinction designations awarded to the
118118 campus under Subchapter G;
119119 (2) may permit a district or school to assign weights
120120 to each domain, [or] set of accountability measures, or distinction
121121 designations described in Subdivision (1), as determined by the
122122 district or school, provided that the domains specified in
123123 Subdivision (1)(A) must in the aggregate account for at least 50
124124 percent of the overall performance rating;
125125 (3) must require that each locally developed domain or
126126 set of accountability measures:
127127 (A) contains levels of performance that allow for
128128 differentiation, with assigned standards for achieving the
129129 differentiated levels;
130130 (B) provides for the assignment of a letter grade
131131 of A, B, C, D, or F; and
132132 (C) meets standards for reliability and
133133 validity;
134134 (4) must require that calculations for overall
135135 performance ratings and each locally developed domain or set of
136136 accountability measures be capable of being audited by a third
137137 party;
138138 (5) must require that a district or school produce a
139139 campus score card that may be displayed on the agency's website; and
140140 (6) must require that a district or school develop and
141141 make available to the public an explanation of the methodology used
142142 to assign performance ratings under this section.
143143 SECTION 3. Section 39.202, Education Code, is amended to
144144 read as follows:
145145 Sec. 39.202. ACADEMIC DISTINCTION DESIGNATION FOR
146146 DISTRICTS AND CAMPUSES. The commissioner by rule shall establish
147147 an academic distinction designation for districts and campuses for
148148 outstanding performance in attainment of postsecondary readiness.
149149 The commissioner shall adopt criteria for the designation under
150150 this section, including:
151151 (1) percentages of students who:
152152 (A) performed satisfactorily, as determined
153153 under the college readiness performance standard under Section
154154 39.0241, on assessment instruments required under Section
155155 39.023(a), (b), (c), or (l), aggregated across grade levels by
156156 subject area; or
157157 (B) met the standard for annual improvement, as
158158 determined by the agency under Section 39.034, on assessment
159159 instruments required under Section 39.023(a), (b), (c), or (l),
160160 aggregated across grade levels by subject area, for students who
161161 did not perform satisfactorily as described by Paragraph (A);
162162 (2) percentages of:
163163 (A) students who earned a nationally or
164164 internationally recognized business or industry certification or
165165 license;
166166 (B) students who completed a coherent sequence of
167167 career and technical courses;
168168 (C) students who completed a dual credit course
169169 or an articulated postsecondary course provided for local credit;
170170 (D) students who achieved applicable College
171171 Readiness Benchmarks or the equivalent on the Preliminary
172172 Scholastic Assessment Test (PSAT), the Scholastic Assessment Test
173173 (SAT), the American College Test (ACT), or the ACT-Plan assessment
174174 program; [and]
175175 (E) students who received a score on either an
176176 advanced placement test or an international baccalaureate
177177 examination to be awarded college credit; and
178178 (F) students who completed a Pathways in
179179 Technology Early College High School (P-TECH) program established
180180 under Subchapter N, Chapter 29, or another early college high
181181 school program; and
182182 (3) other factors for determining sufficient student
183183 attainment of postsecondary readiness.
184184 SECTION 4. Section 48.106(a-1), Education Code, is amended
185185 to read as follows:
186186 (a-1) In addition to the amounts under Subsection (a), for
187187 each student in average daily attendance, a district is entitled to
188188 $150 [$50] for each of the following in which the student is
189189 enrolled:
190190 (1) a campus designated as a P-TECH school under
191191 Section 29.556; or
192192 (2) a campus that is a member of the New Tech Network
193193 and that focuses on project-based learning and work-based
194194 education.
195195 SECTION 5. This Act applies beginning with the 2024-2025
196196 school year.
197197 SECTION 6. This Act takes effect immediately if it receives
198198 a vote of two-thirds of all the members elected to each house, as
199199 provided by Section 39, Article III, Texas Constitution. If this
200200 Act does not receive the vote necessary for immediate effect, this
201201 Act takes effect on the 91st day after the last day of the
202202 legislative session.
