66 AN ACT
77 relating to prohibiting certain limitations on the operation of
88 certain organizations that benefit veterans during certain
99 declared states of disaster.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 418.012, Government Code, is amended to
1212 read as follows:
1313 Sec. 418.012. EXECUTIVE ORDERS. (a) Under this chapter,
1414 the governor may issue executive orders, proclamations, and
1515 regulations and amend or rescind them. Executive orders,
1616 proclamations, and regulations have the force and effect of law.
1717 (b) An executive order, proclamation, or regulation issued
1818 by the governor under this chapter during a pandemic that restricts
1919 the operation of or the hours of operation for a business that sells
2020 alcoholic beverages may not include an organization exempt from
2121 federal taxation under Section 501(a), Internal Revenue Code of
2222 1986, as an organization described by Section 501(c)(19) of that
2323 code, that benefits veterans of the United States armed forces.
2424 SECTION 2. Section 418.012, Government Code, as amended by
2525 this Act, applies only to a declaration of a state of disaster
2626 issued or renewed on or after the effective date of this Act. A
2727 declaration issued before the effective date of this Act is
2828 governed by the law in effect immediately before the effective date
2929 of this Act, and that law is continued in effect for that purpose.
3030 SECTION 3. This Act takes effect on the 91st day after the
3131 last day of the legislative session.
