55 AN ACT
66 relating to the basic allotment and guaranteed yield under the
77 Foundation School Program, including an adjustment in those amounts
88 to reflect inflation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 48.051, Education Code, is amended by
1111 amending Subsection (a) and adding Subsection (a-1) to read as
1212 follows:
1313 (a) Subject to adjustment under Subsection (a-1), for [For]
1414 each student in average daily attendance, not including the time
1515 students spend each day in special education programs in an
1616 instructional arrangement other than mainstream or career and
1717 technology education programs, for which an additional allotment is
1818 made under Subchapter C, a district is entitled to an allotment
1919 equal to the lesser of $7,365 [$6,160] or the amount that results
2020 from the following formula:
2121 A = $7,365 [$6,160] X TR/MCR
2222 where:
2323 "A" is the allotment to which a district is entitled;
2424 "TR" is the district's tier one maintenance and operations
2525 tax rate, as provided by Section 45.0032; and
2626 "MCR" is the district's maximum compressed tax rate, as
2727 determined under Section 48.2551.
2828 (a-1) Beginning with the 2024-2025 school year, the basic
2929 allotment provided to a district under Subsection (a) or (b) is
3030 adjusted annually to increase the allotment by a factor equal to the
3131 average annual percentage increase, if any, in the Consumer Price
3232 Index for All Urban Consumers published by the Bureau of Labor
3333 Statistics of the United States Department of Labor for the
3434 preceding five years.
3535 SECTION 2. Section 48.115(a), Education Code, is amended to
3636 read as follows:
3737 (a) Except as provided by Subsection (a-1), a school
3838 district is entitled to an annual allotment equal to the sum of the
3939 following amounts or a greater amount provided by appropriation:
4040 (1) $10 for each student in average daily attendance,
4141 plus $1 for each student in average daily attendance per every $50
4242 by which the district's maximum basic allotment under Section
4343 48.051 exceeds $7,365 [$6,160], prorated as necessary; and
4444 (2) $15,000 per campus.
4545 SECTION 3. Section 48.202(a-1), Education Code, is amended
4646 to read as follows:
4747 (a-1) For purposes of Subsection (a), the dollar amount
4848 guaranteed level of state and local funds per weighted student per
4949 cent of tax effort ("GL") for a school district is:
5050 (1) the greater of the amount of district tax revenue
5151 per weighted student per cent of tax effort available to a school
5252 district at the 96th percentile of wealth per weighted student or
5353 the amount that results from multiplying the maximum amount of the
5454 basic allotment provided under Section 48.051 for the applicable
5555 school year [6,160, or the greater amount provided under Section
5656 48.051(b), if applicable,] by 0.016, for the first eight cents by
5757 which the district's maintenance and operations tax rate exceeds
5858 the district's tier one tax rate; and
5959 (2) subject to Subsection (f), the amount that results
6060 from multiplying the maximum amount of the basic allotment provided
6161 under Section 48.051 for the applicable school year [$6,160, or the
6262 greater amount provided under Section 48.051(b), if applicable,] by
6363 0.008, for the district's maintenance and operations tax effort
6464 that exceeds the amount of tax effort described by Subdivision (1).
6565 SECTION 4. This Act takes effect on the 91st day after the
6666 last day of the legislative session.
