44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the eligibility of certain children of classroom
77 teachers for enrollment in a free prekindergarten program.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 29.153(b), Education Code, is amended to
1010 read as follows:
1111 (b) A child is eligible for enrollment in a prekindergarten
1212 class under this section if the child is at least three years of age
1313 and:
1414 (1) is unable to speak and comprehend the English
1515 language;
1616 (2) is educationally disadvantaged;
1717 (3) is homeless, regardless of the residence of the
1818 child, of either parent of the child, or of the child's guardian or
1919 other person having lawful control of the child;
2020 (4) is the child of an active duty member of the armed
2121 forces of the United States, including the state military forces or
2222 a reserve component of the armed forces, who is ordered to active
2323 duty by proper authority;
2424 (5) is the child of a member of the armed forces of the
2525 United States, including the state military forces or a reserve
2626 component of the armed forces, who was injured or killed while
2727 serving on active duty;
2828 (6) is or ever has been in:
2929 (A) the conservatorship of the Department of
3030 Family and Protective Services following an adversary hearing held
3131 as provided by Section 262.201, Family Code; or
3232 (B) foster care in another state or territory, if
3333 the child resides in this state; [or]
3434 (7) is the child of a person eligible for the Star of
3535 Texas Award as:
3636 (A) a peace officer under Section 3106.002,
3737 Government Code;
3838 (B) a firefighter under Section 3106.003,
3939 Government Code; or
4040 (C) an emergency medical first responder under
4141 Section 3106.004, Government Code; or
4242 (8) is the child of a person employed as a classroom
4343 teacher at a public primary or secondary school in this state.
4444 SECTION 2. This Act applies beginning with the 2024-2025
4545 school year.
4646 SECTION 3. This Act takes effect immediately if it receives
4747 a vote of two-thirds of all the members elected to each house, as
4848 provided by Section 39, Article III, Texas Constitution. If this
4949 Act does not receive the vote necessary for immediate effect, this
5050 Act takes effect on the 91st day after the last day of the
5151 legislative session.
