66 AN ACT
77 relating to the defense to prosecution for certain offenses
88 involving possession of small amounts of controlled substances,
99 marihuana, dangerous drugs, or abusable volatile chemicals, or
1010 possession of drug paraphernalia for defendants seeking assistance
1111 for a suspected overdose.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 481.115(h), Health and Safety Code, is
1414 amended to read as follows:
1515 (h) The defense to prosecution provided by Subsection (g) is
1616 not available if[:
1717 [(1)] at the time the request for emergency medical
1818 assistance was made:
1919 (1) [(A)] a peace officer was in the process of
2020 arresting the actor or executing a search warrant describing the
2121 actor or the place from which the request for medical assistance was
2222 made; or
2323 (2) [(B)] the actor is committing another offense,
2424 other than an offense punishable under Section 481.1151(b)(1),
2525 481.116(b), 481.1161(b)(1) or (2), 481.117(b), 481.118(b), or
2626 481.121(b)(1) or (2), or an offense under Section 481.119(b),
2727 481.125(a), 483.041(a), or 485.031(a)[;
2828 [(2) the actor has been previously convicted of or
2929 placed on deferred adjudication community supervision for an
3030 offense under this chapter or Chapter 483 or 485;
3131 [(3) the actor was acquitted in a previous proceeding
3232 in which the actor successfully established the defense under that
3333 subsection or Section 481.1151(c), 481.116(f), 481.1161(c),
3434 481.117(f), 481.118(f), 481.119(c), 481.121(c), 481.125(g),
3535 483.041(e), or 485.031(c); or
3636 [(4) at any time during the 18-month period preceding
3737 the date of the commission of the instant offense, the actor
3838 requested emergency medical assistance in response to the possible
3939 overdose of the actor or another person].
4040 SECTION 2. Section 481.1151(d), Health and Safety Code, is
4141 amended to read as follows:
4242 (d) The defense to prosecution provided by Subsection (c) is
4343 not available if[:
4444 [(1)] at the time the request for emergency medical
4545 assistance was made:
4646 (1) [(A)] a peace officer was in the process of
4747 arresting the actor or executing a search warrant describing the
4848 actor or the place from which the request for medical assistance was
4949 made; or
5050 (2) [(B)] the actor is committing another offense,
5151 other than an offense punishable under Section 481.115(b),
5252 481.116(b), 481.1161(b)(1) or (2), 481.117(b), 481.118(b), or
5353 481.121(b)(1) or (2), or an offense under Section 481.119(b),
5454 481.125(a), 483.041(a), or 485.031(a)[;
5555 [(2) the actor has been previously convicted of or
5656 placed on deferred adjudication community supervision for an
5757 offense under this chapter or Chapter 483 or 485;
5858 [(3) the actor was acquitted in a previous proceeding
5959 in which the actor successfully established the defense under that
6060 subsection or Section 481.115(g), 481.116(f), 481.1161(c),
6161 481.117(f), 481.118(f), 481.119(c), 481.121(c), 481.125(g),
6262 483.041(e), or 485.031(c); or
6363 [(4) at any time during the 18-month period preceding
6464 the date of the commission of the instant offense, the actor
6565 requested emergency medical assistance in response to the possible
6666 overdose of the actor or another person].
6767 SECTION 3. Section 481.116(g), Health and Safety Code, is
6868 amended to read as follows:
6969 (g) The defense to prosecution provided by Subsection (f) is
7070 not available if[:
7171 [(1)] at the time the request for emergency medical
7272 assistance was made:
7373 (1) [(A)] a peace officer was in the process of
7474 arresting the actor or executing a search warrant describing the
7575 actor or the place from which the request for medical assistance was
7676 made; or
7777 (2) [(B)] the actor is committing another offense,
7878 other than an offense punishable under Section 481.115(b),
7979 481.1151(b)(1), 481.1161(b)(1) or (2), 481.117(b), 481.118(b), or
8080 481.121(b)(1) or (2), or an offense under Section 481.119(b),
8181 481.125(a), 483.041(a), or 485.031(a)[;
8282 [(2) the actor has been previously convicted of or
8383 placed on deferred adjudication community supervision for an
8484 offense under this chapter or Chapter 483 or 485;
8585 [(3) the actor was acquitted in a previous proceeding
8686 in which the actor successfully established the defense under that

9494 SECTION 4. Section 481.1161(d), Health and Safety Code, is
9595 amended to read as follows:
9696 (d) The defense to prosecution provided by Subsection (c) is
9797 not available if[:
9898 [(1)] at the time the request for emergency medical
9999 assistance was made:
100100 (1) [(A)] a peace officer was in the process of
101101 arresting the actor or executing a search warrant describing the
102102 actor or the place from which the request for medical assistance was
103103 made; or
104104 (2) [(B)] the actor is committing another offense,
105105 other than an offense punishable under Section 481.115(b),
106106 481.1151(b)(1), 481.116(b), 481.117(b), 481.118(b), or
107107 481.121(b)(1) or (2), or an offense under Section 481.119(b),
108108 481.125(a), 483.041(a), or 485.031(a)[;
109109 [(2) the actor has been previously convicted of or
110110 placed on deferred adjudication community supervision for an
111111 offense under this chapter or Chapter 483 or 485;
112112 [(3) the actor was acquitted in a previous proceeding

121121 SECTION 5. Section 481.117(g), Health and Safety Code, is
122122 amended to read as follows:
123123 (g) The defense to prosecution provided by Subsection (f) is
124124 not available if[:
125125 [(1)] at the time the request for emergency medical
126126 assistance was made:
127127 (1) [(A)] a peace officer was in the process of
128128 arresting the actor or executing a search warrant describing the
129129 actor or the place from which the request for medical assistance was

148148 SECTION 6. Section 481.118(g), Health and Safety Code, is
149149 amended to read as follows:
150150 (g) The defense to prosecution provided by Subsection (f) is
151151 not available if[:
152152 [(1)] at the time the request for emergency medical
153153 assistance was made:
154154 (1) [(A)] a peace officer was in the process of
155155 arresting the actor or executing a search warrant describing the
156156 actor or the place from which the request for medical assistance was
157157 made; or
158158 (2) [(B)] the actor is committing another offense,
159159 other than an offense punishable under Section 481.115(b),
160160 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b), or
161161 481.121(b)(1) or (2), or an offense under Section 481.119(b),

171171 [(4) at any time during the 18-month period preceding
172172 the date of the commission of the instant offense, the actor
173173 requested emergency medical assistance in response to the possible
174174 overdose of the actor or another person].
175175 SECTION 7. Section 481.119(d), Health and Safety Code, is
176176 amended to read as follows:
177177 (d) The defense to prosecution provided by Subsection (c) is
178178 not available if[:
179179 [(1)] at the time the request for emergency medical
180180 assistance was made:
181181 (1) [(A)] a peace officer was in the process of
182182 arresting the actor or executing a search warrant describing the
183183 actor or the place from which the request for medical assistance was
184184 made; or
185185 (2) [(B)] the actor is committing another offense,
186186 other than an offense punishable under Section 481.115(b),
187187 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b),
188188 481.118(b), or 481.121(b)(1) or (2), or an offense under Section

198198 [(4) at any time during the 18-month period preceding
199199 the date of the commission of the instant offense, the actor
200200 requested emergency medical assistance in response to the possible
201201 overdose of the actor or another person].
202202 SECTION 8. Section 481.121(d), Health and Safety Code, is
203203 amended to read as follows:
204204 (d) The defense to prosecution provided by Subsection (c) is
205205 not available if[:
206206 [(1)] at the time the request for emergency medical
207207 assistance was made:
208208 (1) [(A)] a peace officer was in the process of
209209 arresting the actor or executing a search warrant describing the
210210 actor or the place from which the request for medical assistance was
211211 made; or
212212 (2) [(B)] the actor is committing another offense,
213213 other than an offense punishable under Section 481.115(b),
214214 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b), or
215215 481.118(b), or an offense under Section 481.119(b), 481.125(a),
216216 483.041(a), or 485.031(a)[;
217217 [(2) the actor has been previously convicted of or
218218 placed on deferred adjudication community supervision for an
219219 offense under this chapter or Chapter 483 or 485;
220220 [(3) the actor was acquitted in a previous proceeding

222222 subsection or Section 481.115(g), 481.1151(c), 481.116(f),

224224 483.041(e), or 485.031(c); or
225225 [(4) at any time during the 18-month period preceding
226226 the date of the commission of the instant offense, the actor
227227 requested emergency medical assistance in response to the possible
228228 overdose of the actor or another person].
229229 SECTION 9. Section 481.125(h), Health and Safety Code, is
230230 amended to read as follows:
231231 (h) The defense to prosecution provided by Subsection (g) is
232232 not available if[:
233233 [(1)] at the time the request for emergency medical
234234 assistance was made:
235235 (1) [(A)] a peace officer was in the process of
236236 arresting the actor or executing a search warrant describing the
237237 actor or the place from which the request for medical assistance was
238238 made; or
239239 (2) [(B)] the actor is committing another offense,
240240 other than an offense punishable under Section 481.115(b),

256256 SECTION 10. Section 483.041(f), Health and Safety Code, is
257257 amended to read as follows:
258258 (f) The defense to prosecution provided by Subsection (e) is
259259 not available if[:
260260 [(1)] at the time the request for emergency medical
261261 assistance was made:
262262 (1) [(A)] a peace officer was in the process of
263263 arresting the actor or executing a search warrant describing the
264264 actor or the place from which the request for medical assistance was
265265 made; or
266266 (2) [(B)] the actor is committing another offense,
267267 other than an offense punishable under Section 481.115(b),
268268 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b),
269269 481.118(b), or 481.121(b)(1) or (2), or an offense under Section
270270 481.119(b), 481.125(a), or 485.031(a)[;
271271 [(2) the actor has been previously convicted of or
272272 placed on deferred adjudication community supervision for an
273273 offense under this chapter or Chapter 481 or 485;
274274 [(3) the actor was acquitted in a previous proceeding
275275 in which the actor successfully established the defense under that
276276 subsection or Section 481.115(g), 481.1151(c), 481.116(f),

283283 SECTION 11. Section 485.031(d), Health and Safety Code, is
284284 amended to read as follows:
285285 (d) The defense to prosecution provided by Subsection (c) is
286286 not available if[:
287287 [(1)] at the time the request for emergency medical
288288 assistance was made:
289289 (1) [(A)] a peace officer was in the process of
290290 arresting the actor or executing a search warrant describing the
291291 actor or the place from which the request for medical assistance was
292292 made; or
293293 (2) [(B)] the actor is committing another offense,
294294 other than an offense punishable under Section 481.115(b),
295295 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b),
296296 481.118(b), or 481.121(b)(1) or (2), or an offense under Section
297297 481.119(b), 481.125(a), or 483.041(a)[;
298298 [(2) the actor has been previously convicted of or
299299 placed on deferred adjudication community supervision for an
300300 offense under this chapter or Chapter 481 or 483;
301301 [(3) the actor was acquitted in a previous proceeding
302302 in which the actor successfully established the defense under that
303303 subsection or Section 481.115(g), 481.1151(c), 481.116(f),
304304 481.1161(c), 481.117(f), 481.118(f), 481.119(c), 481.121(c),
305305 481.125(g), or 483.041(e); or
306306 [(4) at any time during the 18-month period preceding
307307 the date of the commission of the instant offense, the actor
308308 requested emergency medical assistance in response to the possible
309309 overdose of the actor or another person].
310310 SECTION 12. The changes in law made by this Act apply only
311311 to an offense committed on or after the effective date of this Act.
312312 An offense committed before the effective date of this Act is
313313 governed by the law in effect on the date the offense was committed,
314314 and the former law is continued in effect for that purpose. For
315315 purposes of this section, an offense was committed before the
316316 effective date of this Act if any element of the offense occurred
317317 before that date.
318318 SECTION 13. This Act takes effect on the 91st day after the
319319 last day of the legislative session.
