66 AN ACT
77 relating to a uniform coordination of benefits questionnaire for
88 health benefit plans.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 1203, Insurance Code, is amended by
1111 adding Subchapter D to read as follows:
1212 SUBCHAPTER D. COORDINATION OF BENEFITS QUESTIONNAIRE
1313 Sec. 1203.151. APPLICABILITY OF SUBCHAPTER. (a) This
1414 subchapter applies only to a health benefit plan that provides
1515 benefits for medical or surgical expenses incurred as a result of a
1616 health condition, accident, or sickness, including an individual,
1717 group, blanket, or franchise insurance policy or insurance
1818 agreement, a group hospital service contract, or an individual or
1919 group evidence of coverage or similar coverage document that is
2020 issued by:
2121 (1) an insurance company;
2222 (2) a group hospital service corporation operating
2323 under Chapter 842;
2424 (3) a health maintenance organization operating under
2525 Chapter 843;
2626 (4) an approved nonprofit health corporation that
2727 holds a certificate of authority under Chapter 844;
2828 (5) a multiple employer welfare arrangement that holds
2929 a certificate of authority under Chapter 846;
3030 (6) a stipulated premium company operating under
3131 Chapter 884;
3232 (7) a Lloyd's plan operating under Chapter 941; or
3333 (8) an exchange operating under Chapter 942.
3434 (b) Notwithstanding any other law, this subchapter applies
3535 to:
3636 (1) a small employer health benefit plan subject to
3737 Chapter 1501, including coverage provided through a health group
3838 cooperative under Subchapter B of that chapter;
3939 (2) a standard health benefit plan issued under
4040 Chapter 1507;
4141 (3) a basic coverage plan under Chapter 1551;
4242 (4) a basic plan under Chapter 1575;
4343 (5) a primary care coverage plan under Chapter 1579;
4444 (6) a plan providing basic coverage under Chapter
4545 1601;
4646 (7) alternative health benefit coverage offered by a
4747 subsidiary of the Texas Mutual Insurance Company under Subchapter
4848 M, Chapter 2054;
4949 (8) group health coverage made available by a school
5050 district in accordance with Section 22.004, Education Code;
5151 (9) the state Medicaid program, including the Medicaid
5252 managed care program operated under Chapter 533, Government Code;
5353 (10) the child health plan program under Chapter 62,
5454 Health and Safety Code;
5555 (11) a regional or local health care program operated
5656 under Section 75.104, Health and Safety Code; and
5757 (12) a self-funded health benefit plan sponsored by a
5858 professional employer organization under Chapter 91, Labor Code.
5959 Sec. 1203.152. CREATION OF UNIFORM COORDINATION OF BENEFITS
6060 QUESTIONNAIRE. In collaboration with appropriate stakeholders,
6161 the commissioner shall adopt rules establishing a uniform
6262 coordination of benefits questionnaire to be used by all health
6363 benefit plan issuers in this state.
6464 Sec. 1203.153. UNIFORM COORDINATION OF BENEFITS
6565 QUESTIONNAIRE REQUIRED. Each health benefit plan issuer that
6666 issues a health benefit plan that includes a coordination of
6767 benefits provision shall use the uniform coordination of benefits
6868 questionnaire established under Section 1203.152 and make the
6969 questionnaire available to health care providers as appropriate.
7070 SECTION 2. (a) Not later than the 121st day after the
7171 effective date of this Act, the commissioner of insurance shall
7272 adopt rules establishing the uniform coordination of benefits
7373 questionnaire under Section 1203.152, Insurance Code, as added by
7474 this Act.
7575 (b) The changes in law made by this Act apply only to the use
7676 of a coordination of benefits questionnaire on or after the 151st
7777 day after the effective date of this Act.
7878 SECTION 3. This Act takes effect on the 91st day after the
7979 last day of the legislative session.
