88 AN ACT
99 relating to certain political subdivisions publishing required
1010 notices by alternative media.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 2051, Government Code, is amended by
1313 adding Subchapter C-1 to read as follows:
1414 SUBCHAPTER C-1. NOTICE BY PUBLICATION IN MEDIA OTHER THAN
1515 NEWSPAPER BY CERTAIN POLITICAL SUBDIVISIONS
1616 Sec. 2051.081. APPLICABILITY. This subchapter applies only
1717 to a political subdivision with a population of 75,000 or less and
1818 in which there is no newspaper of general circulation. If no
1919 population is specified for a political subdivision in the federal
2020 decennial census, the population of the political subdivision is
2121 the population determined by the attorney general for purposes of
2222 this section.
2323 Sec. 2051.082. NOTICE BY ALTERNATIVE MEDIA. (a) A
2424 political subdivision may satisfy a requirement in any other law to
2525 provide notice by publication in a newspaper by publishing the
2626 notice:
2727 (1) by media described by Subsection (d); and
2828 (2) for a continuous period of not less than two weeks
2929 in a prominent location on an Internet website maintained by the
3030 political subdivision that does not require user registration or
3131 payment for access.
3232 (b) A political subdivision that publishes notice on an
3333 Internet website under Subsection (a)(2) must ensure that:
3434 (1) the Internet website and the notices are
3535 searchable; and
3636 (2) a user is able to search the notices by:
3737 (A) subject matter;
3838 (B) the location required to be provided in the
3939 notice under the other laws that require notice by publication in a
4040 newspaper; and
4141 (C) both subject matter and location.
4242 (c) Before providing notice by an alternative method under
4343 Subsection (a), a political subdivision must hold a public meeting
4444 about the alternative notice method.
4545 (d) The following forms of media are authorized for
4646 providing notice under Subsection (a)(1):
4747 (1) social media;
4848 (2) free newspapers;
4949 (3) school newspapers;
5050 (4) a homeowners' association newsletter or magazine;
5151 (5) utility bills;
5252 (6) direct mailings; and
5353 (7) a print or digital newsletter.
5454 (e) A political subdivision that provides notice using
5555 alternative media under this section shall submit notice to the
5656 attorney general describing the alternative notice method that
5757 includes:
5858 (1) a list of the other laws requiring notice by
5959 publication in a newspaper for which notice published under this
6060 section is an alternative;
6161 (2) a description of the alternative media used for
6262 the notice; and
6363 (3) a link to the Internet website maintained by the
6464 political subdivision where the public notice will be posted.
6565 (f) After receipt of the notice under Subsection (e), the
6666 attorney general shall promptly publish on the attorney general's
6767 Internet website a list of political subdivisions that provide
6868 notice as described by this subchapter.
6969 Sec. 2051.083. RULEMAKING AUTHORITY. The attorney general
7070 may adopt rules necessary to administer this subchapter.
7171 SECTION 2. This Act takes effect September 1, 2025.
