| 12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 13 | 13 | SECTION 1. Section 388.001, Local Government Code, is | |
| 14 | 14 | amended to read as follows: | |
| 15 | 15 | Sec. 388.001. APPLICABILITY. This chapter applies only | |
| 16 | 16 | to: | |
| 17 | 17 | (1) a county that: | |
| 18 | 18 | (A) [(1)] has a population of less [not more] | |
| 19 | 19 | than 3,000; | |
| 20 | 20 | (B) [(2)] is adjacent to at least three counties | |
| 21 | 21 | with populations of less than 10,000; and | |
| 22 | 22 | (C) [(3)] is located on an international border; | |
| 23 | 23 | and | |
| 24 | 24 | (2) a county: | |
| 25 | 25 | (A) that is located on an international border; | |
| 26 | 26 | and | |
| 27 | 27 | (B) in which is partially located a national park | |
| 28 | 28 | of less than 100,000 acres. | |
| 29 | 29 | SECTION 2. This Act takes effect immediately if it receives | |
| 30 | 30 | a vote of two-thirds of all the members elected to each house, as | |
| 31 | 31 | provided by Section 39, Article III, Texas Constitution. If this | |
| 32 | 32 | Act does not receive the vote necessary for immediate effect, this | |
| 33 | 33 | Act takes effect September 1, 2025. |
