77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the punishment for certain theft offenses.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 31.03(e), Penal Code, is amended to read
1212 as follows:
1313 (e) Except as provided by Subsections (f) and (f-1), an
1414 offense under this section is:
1515 (1) a Class C misdemeanor if the value of the property
1616 stolen is less than $100;
1717 (2) a Class B misdemeanor if:
1818 (A) the value of the property stolen is $100 or
1919 more but less than $300 [$750];
2020 (B) the value of the property stolen is less than
2121 $100 and the defendant has previously been convicted of any grade of
2222 theft; or
2323 (C) the property stolen is a driver's license,
2424 commercial driver's license, or personal identification
2525 certificate issued by this state or another state;
2626 (3) a Class A misdemeanor if the value of the property
2727 stolen is $300 [$750] or more but less than $750 [$2,500];
2828 (4) a state jail felony if:
2929 (A) the value of the property stolen is $750
3030 [$2,500] or more but less than $30,000, or the property is less than
3131 10 head of sheep, swine, or goats or any part thereof under the
3232 value of $30,000;
3333 (B) regardless of value, the property is stolen
3434 from the person of another or from a human corpse or grave,
3535 including property that is a military grave marker;
3636 (C) the property stolen is a firearm;
3737 (D) the value of the property stolen is less than
3838 $750 [$2,500] and the defendant has been previously convicted two
3939 or more times of any grade of theft;
4040 (E) the property stolen is an official ballot or
4141 official carrier envelope for an election;
4242 (F) the value of the property stolen is less than
4343 $30,000 [$20,000] and the property stolen is:
4444 (i) aluminum;
4545 (ii) bronze;
4646 (iii) copper; or
4747 (iv) brass; or
4848 (G) the cost of replacing the property stolen is
4949 less than $30,000 and the property stolen is a catalytic converter;
5050 (5) a felony of the third degree if the value of the
5151 property stolen is $30,000 or more but less than $150,000, or the
5252 property is:
5353 (A) cattle, horses, or exotic livestock or exotic
5454 fowl as defined by Section 142.001, Agriculture Code, stolen during
5555 a single transaction and having an aggregate value of less than
5656 $150,000;
5757 (B) 10 or more head of sheep, swine, or goats
5858 stolen during a single transaction and having an aggregate value of
5959 less than $150,000; or
6060 (C) a controlled substance, having a value of
6161 less than $150,000, if stolen from:
6262 (i) a commercial building in which a
6363 controlled substance is generally stored, including a pharmacy,
6464 clinic, hospital, nursing facility, or warehouse; or
6565 (ii) a vehicle owned or operated by a
6666 wholesale distributor of prescription drugs;
6767 (6) a felony of the second degree if:
6868 (A) the value of the property stolen is $150,000
6969 or more but less than $300,000; or
7070 (B) the value of the property stolen is less than
7171 $300,000 and the property stolen is an automated teller machine or
7272 the contents or components of an automated teller machine; or
7373 (7) a felony of the first degree if the value of the
7474 property stolen is $300,000 or more.
7575 SECTION 2. Section 31.04(e), Penal Code, is amended to read
7676 as follows:
7777 (e) An offense under this section is:
7878 (1) a Class C misdemeanor if the value of the service
7979 stolen is less than $100;
8080 (2) a Class B misdemeanor if the value of the service
8181 stolen is $100 or more but less than $300 [$750];
8282 (3) a Class A misdemeanor if the value of the service
8383 stolen is $300 [$750] or more but less than $750 [$2,500];
8484 (4) a state jail felony if the value of the service
8585 stolen is $750 [$2,500] or more but less than $30,000;
8686 (5) a felony of the third degree if the value of the
8787 service stolen is $30,000 or more but less than $150,000;
8888 (6) a felony of the second degree if the value of the
8989 service stolen is $150,000 or more but less than $300,000; or
9090 (7) a felony of the first degree if the value of the
9191 service stolen is $300,000 or more.
9292 SECTION 3. Section 31.16(c), Penal Code, is amended to read
9393 as follows:
9494 (c) An offense under this section is:
9595 (1) a Class C misdemeanor if the total value of the
9696 merchandise involved in the activity is less than $100;
9797 (2) a Class B misdemeanor if the total value of the
9898 merchandise involved in the activity is $100 or more but less than
9999 $300 [$750];
100100 (3) a Class A misdemeanor if the total value of the
101101 merchandise involved in the activity is $300 [$750] or more but less
102102 than $750 [$2,500];
103103 (4) a state jail felony if the total value of the
104104 merchandise involved in the activity is $750 [$2,500] or more but
105105 less than $30,000;
106106 (5) a felony of the third degree if the total value of
107107 the merchandise involved in the activity is $30,000 or more but less
108108 than $150,000;
109109 (6) a felony of the second degree if the total value of
110110 the merchandise involved in the activity is $150,000 or more but
111111 less than $300,000; or
112112 (7) a felony of the first degree if the total value of
113113 the merchandise involved in the activity is $300,000 or more.
114114 SECTION 4. The changes in law made by this Act apply only to
115115 an offense committed on or after the effective date of this Act. An
116116 offense committed before the effective date of this Act is governed
117117 by the law in effect on the date the offense was committed, and the
118118 former law is continued in effect for that purpose. For purposes of
119119 this section, an offense was committed before the effective date of
120120 this Act if any element of the offense occurred before that date.
121121 SECTION 5. This Act takes effect September 1, 2025.
