77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to health benefit plan coverage of treatment for chemical
1010 dependency.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1368.001(2), Insurance Code, is amended
1313 to read as follows:
1414 (2) "Chemical dependency treatment center" means a
1515 facility that provides a program for the treatment of chemical
1616 dependency under a written treatment plan approved and monitored by
1717 a physician and that is:
1818 (A) affiliated with a hospital under a
1919 contractual agreement with an established system for patient
2020 referral;
2121 (B) accredited as a chemical dependency
2222 treatment center by the Joint Commission on Accreditation of
2323 Healthcare Organizations;
2424 (C) licensed as a chemical dependency treatment
2525 program by the Health and Human Services [Texas] Commission [on
2626 Alcohol and Drug Abuse]; or
2727 (D) licensed, certified, or approved as a
2828 chemical dependency treatment program or center by another state
2929 agency.
3030 SECTION 2. Sections 1368.002, 1368.003, and 1368.004,
3131 Insurance Code, are amended to read as follows:
3232 Sec. 1368.002. APPLICABILITY OF CHAPTER. (a) This chapter
3333 applies only to a [group] health benefit plan that provides
3434 hospital and medical coverage or services on an expense incurred,
3535 service, or prepaid basis, including an individual or a group
3636 insurance policy or contract or self-funded or self-insured plan or
3737 arrangement that is offered in this state by:
3838 (1) an insurer;
3939 (2) a group hospital service corporation operating
4040 under Chapter 842;
4141 (3) a health maintenance organization operating under
4242 Chapter 843; or
4343 (4) an employer, trustee, or other self-funded or
4444 self-insured plan or arrangement.
4545 (b) Notwithstanding any other law, this chapter applies to:
4646 (1) a basic coverage plan under Chapter 1551;
4747 (2) a basic plan under Chapter 1575;
4848 (3) a primary care coverage plan under Chapter 1579;
4949 or
5050 (4) a plan providing basic coverage under Chapter
5151 1601.
5252 Sec. 1368.003. EXCEPTION. This chapter does not apply to:
5353 (1) [an employer, trustee, or other self-funded or
5454 self-insured plan or arrangement with 250 or fewer employees or
5555 members;
5656 [(2) an individual insurance policy;
5757 [(3) an individual evidence of coverage issued by a
5858 health maintenance organization;
5959 [(4)] a health insurance policy that provides only:
6060 (A) cash indemnity for hospital or other
6161 confinement benefits;
6262 (B) supplemental or limited benefit coverage;
6363 (C) coverage for specified diseases or
6464 accidents;
6565 (D) disability income coverage; or
6666 (E) any combination of those benefits or
6767 coverages;
6868 (2) [(5)] a blanket insurance policy;
6969 (3) [(6)] a short-term travel insurance policy;
7070 (4) [(7)] an accident-only insurance policy;
7171 (5) [(8)] a limited or specified disease insurance
7272 policy;
7373 (6) [(9)] an individual conversion insurance policy
7474 or contract;
7575 (7) [(10)] a policy or contract designed for issuance
7676 to a person eligible for Medicare coverage or other similar
7777 coverage under a state or federal government plan; or
7878 (8) [(11)] an evidence of coverage provided by a
7979 health maintenance organization if the plan holder is the subject
8080 of a collective bargaining agreement that was in effect on January
8181 1, 1982, and that has not expired since that date.
8282 Sec. 1368.004. COVERAGE REQUIRED. (a) A [group] health
8383 benefit plan shall provide coverage for the necessary care and
8484 treatment of chemical dependency.
8585 (b) Coverage required under this section may be provided:
8686 (1) directly by the [group] health benefit plan
8787 issuer; or
8888 (2) by another entity, including a single service
8989 health maintenance organization, under contract with the [group]
9090 health benefit plan issuer.
9191 SECTION 3. Section 1368.005(a), Insurance Code, is amended
9292 to read as follows:
9393 (a) Coverage [Except as provided by Subsection (b),
9494 coverage] required under this chapter[:
9595 [(1)] may not be less favorable than coverage provided
9696 for physical illness generally under the plan[; and
9797 [(2) shall be subject to the same durational limits,
9898 dollar limits, deductibles, and coinsurance factors that apply to
9999 coverage provided for physical illness generally under the plan].
100100 SECTION 4. The heading to Section 1368.006, Insurance Code,
101101 is amended to read as follows:
102102 Sec. 1368.006. LIFETIME LIMITATION ON COVERAGE PROHIBITED.
103103 SECTION 5. Section 1368.006(b), Insurance Code, is amended
104104 to read as follows:
105105 (b) Coverage [Notwithstanding Section 1368.005, coverage]
106106 required under this chapter may not be subject [is limited] to a
107107 lifetime maximum [of three separate treatment series for each
108108 covered individual].
109109 SECTION 6. Sections 1368.007(a) and (b), Insurance Code,
110110 are amended to read as follows:
111111 (a) Coverage provided under this chapter for necessary care
112112 and treatment in a chemical dependency treatment center must be
113113 provided at an appropriate level of [as if the] care [and treatment
114114 were provided in a hospital].
115115 (b) The commissioner [department] by rule shall adopt
116116 standards formulated and approved by the commissioner [department]
117117 and the executive commissioner of the Health and Human Services
118118 Commission [Texas Commission on Alcohol and Drug Abuse] for use by
119119 insurers, other third-party reimbursement sources, and chemical
120120 dependency treatment centers.
121121 SECTION 7. Sections 1368.005(b) and 1368.006(a), Insurance
122122 Code, are repealed.
123123 SECTION 8. The changes in law made by this Act apply only to
124124 a health benefit plan that is delivered, issued for delivery, or
125125 renewed on or after January 1, 2026. A health benefit plan
126126 delivered, issued for delivery, or renewed before January 1, 2026,
127127 is governed by the law as it existed immediately before the
128128 effective date of this Act, and that law is continued in effect for
129129 that purpose.
130130 SECTION 9. This Act takes effect September 1, 2025.
