77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the payment of support rights and benefits for a child
1010 placed with a relative or other designated caregiver.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 264.109(a), Family Code, is amended to
1313 read as follows:
1414 (a) Except as provided by Section 264.763, the [The]
1515 placement of a child in substitute care by the department
1616 constitutes an assignment to the state of any support rights
1717 attributable to the child as of the date the child is placed in
1818 substitute care.
1919 SECTION 2. Subchapter I, Chapter 264, Family Code, is
2020 amended by adding Section 264.763 to read as follows:
2121 Sec. 264.763. PAYMENT OF CHILD'S SUPPORT RIGHTS AND
2222 BENEFITS. A relative or other designated caregiver is eligible to
2323 receive support and benefits on behalf of a child placed with the
2424 person by the department. The department shall facilitate:
2525 (1) the assignment to the relative or other designated
2626 caregiver of any support rights attributable to the child; and
2727 (2) the designation of the relative or other
2828 designated caregiver as the representative payee for any programs,
2929 services, and payments to which the child is entitled or that are
3030 paid for the benefit of the child, including Supplemental Security
3131 Income (SSI) benefits under 42 U.S.C. Section 1381 et seq.
3232 SECTION 3. This Act takes effect September 1, 2025.
