| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 264.109(a), Family Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (a) Except as provided by Section 264.763, the [The] |
|---|
| 15 | 15 | | placement of a child in substitute care by the department |
|---|
| 16 | 16 | | constitutes an assignment to the state of any support rights |
|---|
| 17 | 17 | | attributable to the child as of the date the child is placed in |
|---|
| 18 | 18 | | substitute care. |
|---|
| 19 | 19 | | SECTION 2. Subchapter I, Chapter 264, Family Code, is |
|---|
| 20 | 20 | | amended by adding Section 264.763 to read as follows: |
|---|
| 21 | 21 | | Sec. 264.763. PAYMENT OF CHILD'S SUPPORT RIGHTS AND |
|---|
| 22 | 22 | | BENEFITS. A relative or other designated caregiver is eligible to |
|---|
| 23 | 23 | | receive support and benefits on behalf of a child placed with the |
|---|
| 24 | 24 | | person by the department. The department shall facilitate: |
|---|
| 25 | 25 | | (1) the assignment to the relative or other designated |
|---|
| 26 | 26 | | caregiver of any support rights attributable to the child; and |
|---|
| 27 | 27 | | (2) the designation of the relative or other |
|---|
| 28 | 28 | | designated caregiver as the representative payee for any programs, |
|---|
| 29 | 29 | | services, and payments to which the child is entitled or that are |
|---|
| 30 | 30 | | paid for the benefit of the child, including Supplemental Security |
|---|
| 31 | 31 | | Income (SSI) benefits under 42 U.S.C. Section 1381 et seq. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2025. |
