77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to health benefit plan coverage of telemedicine,
1010 teledentistry, and telehealth appointments with an originating
1111 site or distant site located outside this state.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 1455.001, Insurance Code, is amended by
1414 amending Subdivision (1-a) and adding Subdivisions (1-b) and (1-c)
1515 to read as follows:
1616 (1-a) "Distant site" means the location where a health
1717 professional provides a telemedicine medical service,
1818 teledentistry dental service, or telehealth service.
1919 (1-b) "Health professional" means:
2020 (A) a physician;
2121 (B) an individual who is:
2222 (i) licensed or certified in this state to
2323 perform health care services; and
2424 (ii) authorized to assist:
2525 (a) a physician in providing
2626 telemedicine medical services that are delegated and supervised by
2727 the physician; or
2828 (b) a dentist in providing
2929 teledentistry dental services that are delegated and supervised by
3030 the dentist;
3131 (C) a licensed or certified health professional
3232 acting within the scope of the license or certification who does not
3333 perform a telemedicine medical service or a teledentistry dental
3434 service; or
3535 (D) a dentist.
3636 (1-c) "Originating site" means the location where an
3737 individual receives a telemedicine medical service, teledentistry
3838 dental service, or telehealth service.
3939 SECTION 2. Section 1455.004, Insurance Code, is amended by
4040 adding Subsection (e) to read as follows:
4141 (e) A health benefit plan must provide coverage for a
4242 covered health care service or procedure delivered as a
4343 telemedicine medical service, teledentistry dental service, or
4444 telehealth service with an originating site or distant site located
4545 outside this state on the same basis and to the same extent that the
4646 plan provides coverage for the service or procedure delivered as a
4747 telemedicine medical service, teledentistry dental service, or
4848 telehealth service with an originating site and distant site
4949 located in this state if:
5050 (1) the individual who receives the service resides
5151 primarily in this state; and
5252 (2) the health professional who provides the service:
5353 (A) is licensed or otherwise authorized to
5454 provide the service in this state; and
5555 (B) has a physical office in this state.
5656 SECTION 3. Section 1455.004, Insurance Code, as amended by
5757 this Act, applies only to a health benefit plan delivered, issued
5858 for delivery, or renewed on or after January 1, 2026. A health
5959 benefit plan delivered, issued for delivery, or renewed before
6060 January 1, 2026, is governed by the law as it existed immediately
6161 before the effective date of this Act, and that law is continued in
6262 effect for that purpose.
6363 SECTION 4. This Act takes effect September 1, 2025.
