1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter B, Chapter 91, Natural Resources
14- Code, is amended by adding Section 91.0195 to read as follows:
15- Sec. 91.0195. MAINTENANCE OF OVERHEAD ELECTRICAL POWER
16- LINES. (a) An operator of a well drilled for oil or gas shall
17- maintain in accordance with rules adopted by the commission an
18- overhead electrical distribution system line that is owned or
19- controlled by the operator and associated with operations incident
20- to oil and gas development and production.
21- (b) If the commission determines that an operator has
22- violated a rule adopted under this section, the commission shall
23- assess a penalty against the operator in the manner provided by
24- Sections 81.0532 through 81.0534 for assessing an administrative
25- penalty under Section 81.0531.
14+ Code, is amended by adding Section 91.021 to read as follows:
15+ Sec. 91.021. MAINTENANCE OF CERTAIN IMPROVEMENTS. (a) An
16+ operator of a well drilled for oil or gas shall maintain in
17+ accordance with rules adopted by the commission all land and
18+ infrastructure that is:
19+ (1) associated with operations incident to oil and gas
20+ development production; and
21+ (2) located between the wellhead and a highway, as
22+ defined by Section 366.003, Transportation Code.
23+ (b) If the commission determines that a person has violated
24+ a rule adopted under this section, the commission shall assess a
25+ penalty against the person in the manner provided by Sections
26+ 81.0532 through 81.0534 for assessing an administrative penalty
27+ under Section 81.0531.
2628 SECTION 2. This Act takes effect September 1, 2025.
