77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to ensuring certain adoptive parents may consent to
1010 medical care and access information regarding their child who is
1111 eligible for benefits under Medicaid.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1414 is amended by adding Section 32.02474 to read as follows:
1515 Sec. 32.02474. PARENTAL CONSENT AND ACCESS TO INFORMATION
1616 CONCERNING CERTAIN ADOPTED CHILDREN. The commission shall
1717 collaborate with the Department of Family and Protective Services
1818 to ensure that, if applicable, each adoptive parent of a child
1919 adopted from the conservatorship of the department and eligible for
2020 Medicaid is able to:
2121 (1) consent to the medical care provided to the child
2222 under Medicaid; and
2323 (2) provide and receive information regarding the
2424 child's Medicaid benefits, including:
2525 (A) providing and receiving information through
2626 any electronic interface or system used by the commission to
2727 communicate to or about Medicaid recipients; and
2828 (B) providing information to and receiving
2929 information from:
3030 (i) the commission;
3131 (ii) the Medicaid managed care organization
3232 arranging for or providing the managed care plan in which the child
3333 is enrolled; and
3434 (iii) any health care provider providing
3535 services to the child under Medicaid.
3636 SECTION 2. If before implementing any provision of this Act
3737 a state agency determines that a waiver or authorization from a
3838 federal agency is necessary for implementation of that provision,
3939 the agency affected by the provision shall request the waiver or
4040 authorization and may delay implementing that provision until the
4141 waiver or authorization is granted.
4242 SECTION 3. This Act takes effect September 1, 2025.
