77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a database containing certain records of children who
1010 are not lawfully present in the United States.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 411, Government Code, is amended by
1313 adding Subchapter S to read as follows:
1414 SUBCHAPTER S. DATABASE CONTAINING CERTAIN RECORDS OF CHILDREN NOT
1515 LAWFULLY PRESENT IN UNITED STATES
1616 Sec. 411.551. DEFINITION. In this subchapter, "child"
1717 means an individual who is younger than 18 years of age.
1818 Sec. 411.552. FINGERPRINT RECORDS; INTERVIEWS. (a) An
1919 employee of the department who is working as part of Operation Lone
2020 Star or a successor operation conducted by the department shall:
2121 (1) detain a child who the employee has reasonable
2222 suspicion to believe is not lawfully present in the United States;
2323 (2) obtain a complete set of fingerprints from the
2424 child for purposes of including the fingerprint record in the
2525 database described by Section 411.553; and
2626 (3) conduct a wellness interview with the child to
2727 ensure that the child is safe and not a victim of a trafficking
2828 offense and contact other appropriate state entities if the child
2929 is not safe.
3030 (b) An interview under Subsection (a)(3) must be conducted
3131 outside the presence of any person accompanying the child at the
3232 time the employee detains the child.
3333 (c) A child may not be detained under this section for any
3434 period longer than necessary to satisfy the requirements of
3535 Subsections (a)(2) and (3).
3636 Sec. 411.553. DATABASE. (a) The department shall
3737 establish a database to store the records of fingerprints collected
3838 under Section 411.552 and other information regarding the child's
3939 identity and well-being.
4040 (b) The department shall use the database to investigate the
4141 frequency with which a child described by Section 411.552 has
4242 entered the United States unlawfully through the international
4343 border with Mexico.
4444 (c) The director shall establish best practices for the
4545 database.
4646 (d) The department shall establish a process to ensure that
4747 a child's record is removed from the database as soon as practicable
4848 after a child is determined to be lawfully present in the United
4949 States or on the 15th anniversary of the initial inclusion of the
5050 record in the database, whichever date is earlier.
5151 Sec. 411.554. ACCESS TO DATABASE. The director by rule
5252 shall establish procedures to:
5353 (1) prevent unauthorized access to the database; and
5454 (2) release information maintained in the database.
5555 SECTION 2. As soon as practicable after the effective date
5656 of this Act, the Department of Public Safety shall establish the
5757 database required by Subchapter S, Chapter 411, Government Code,
5858 as added by this Act.
5959 SECTION 3. This Act takes effect September 1, 2025.
