66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the inclusion of Junior Reserve Officer Training Corps
99 and Leadership Officer Training Corps programs as public school
1010 career and technology education programs and the indicator of
1111 achievement for military readiness under the public school
1212 accountability system.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 29.182(b), Education Code, is amended to
1515 read as follows:
1616 (b) The state plan must include procedures designed to
1717 ensure that:
1818 (1) all secondary and postsecondary students have the
1919 opportunity to participate in career and technology education
2020 programs;
2121 (2) the state complies with requirements for
2222 supplemental federal career and technology education funding;
2323 (3) career and technology education is established as
2424 a part of the total education system of this state and constitutes
2525 an option for student learning that provides a rigorous course of
2626 study consistent with the required curriculum under Section 28.002
2727 and under which a student may receive specific education in a career
2828 and technology program that:
2929 (A) incorporates competencies leading to
3030 academic and technical skill attainment;
3131 (B) leads to:
3232 (i) an industry-recognized license,
3333 credential, or certificate; or
3434 (ii) at the postsecondary level, an
3535 associate or baccalaureate degree;
3636 (C) includes opportunities for students to earn
3737 college credit for coursework; and
3838 (D) includes, as an integral part of the program,
3939 participation by students and teachers in activities of career and
4040 technical student organizations supported by the agency and the
4141 State Board of Education; [and]
4242 (4) a school district provides, to the greatest extent
4343 possible, to a student participating in a career and technology
4444 education program opportunities to enroll in dual credit courses
4545 designed to lead to a degree, license, or certification as part of
4646 the program; and
4747 (5) courses of study in a Junior Reserve Officer
4848 Training Corps program or Leadership Officer Training Corps program
4949 are provided as part of a career and technology education program.
5050 SECTION 2. Section 39.053(c), Education Code, is amended to
5151 read as follows:
5252 (c) School districts and campuses must be evaluated based on
5353 three domains of indicators of achievement adopted under this
5454 section that include:
5555 (1) in the student achievement domain, indicators of
5656 student achievement that must include:
5757 (A) for evaluating the performance of districts
5858 and campuses generally:
5959 (i) an indicator that accounts for the
6060 results of assessment instruments required under Sections
6161 39.023(a), (c), and (l), as applicable for the district and campus,
6262 including the results of assessment instruments required for
6363 graduation retaken by a student, aggregated across grade levels by
6464 subject area, including:
6565 (a) for the performance standard
6666 determined by the commissioner under Section 39.0241(a), the
6767 percentage of students who performed satisfactorily on the
6868 assessment instruments, aggregated across grade levels by subject
6969 area; and
7070 (b) for the college readiness
7171 performance standard as determined under Section 39.0241, the
7272 percentage of students who performed satisfactorily on the
7373 assessment instruments, aggregated across grade levels by subject
7474 area; and
7575 (ii) an indicator that accounts for the
7676 results of assessment instruments required under Section
7777 39.023(b), as applicable for the district and campus, including the
7878 percentage of students who performed satisfactorily on the
7979 assessment instruments, as determined by the performance standard
8080 adopted by the agency, aggregated across grade levels by subject
8181 area; and
8282 (B) for evaluating the performance of high school
8383 campuses and districts that include high school campuses,
8484 indicators that account for:
8585 (i) students who satisfy the Texas Success
8686 Initiative (TSI) college readiness benchmarks prescribed by the
8787 Texas Higher Education Coordinating Board under Section 51.334 on
8888 an assessment instrument in reading or mathematics designated by
8989 the coordinating board under that section;
9090 (ii) students who satisfy relevant
9191 performance standards on advanced placement tests or similar
9292 assessments;
9393 (iii) students who earn dual course credits
9494 in the dual credit courses;
9595 (iv) students who demonstrate military
9696 readiness by:
9797 (a) enlisting [enlist] in the armed
9898 forces of the United States or the Texas National Guard;
9999 (b) achieving a passing score set by
100100 the applicable military branch on the Armed Services Vocational
101101 Aptitude Battery test; or
102102 (c) successfully completing a Junior
103103 Reserve Officer Training Corps program;
104104 (v) students who earn industry
105105 certifications;
106106 (vi) students admitted into postsecondary
107107 industry certification programs that require as a prerequisite for
108108 entrance successful performance at the secondary level;
109109 (vii) students whose successful completion
110110 of a course or courses under Section 28.014 indicates the student's
111111 preparation to enroll and succeed, without remediation, in an
112112 entry-level general education course for a baccalaureate degree or
113113 associate degree;
114114 (viii) students who successfully met
115115 standards on a composite of indicators that through research
116116 indicates the student's preparation to enroll and succeed, without
117117 remediation, in an entry-level general education course for a
118118 baccalaureate degree or associate degree;
119119 (ix) high school graduation rates, computed
120120 in accordance with standards and definitions adopted in compliance
121121 with the Every Student Succeeds Act (20 U.S.C. Section 6301 et seq.)
122122 subject to the exclusions provided by Subsections (g), (g-1),
123123 (g-2), (g-3), and (g-4);
124124 (x) students who successfully completed an
125125 OnRamps dual enrollment course;
126126 (xi) students who successfully completed a
127127 practicum or internship approved by the State Board of Education;
128128 (xii) students who are awarded an associate
129129 degree; and
130130 (xiii) students who successfully completed
131131 a program of study in career and technical education;
132132 (2) in the school progress domain, indicators for
133133 effectiveness in promoting student learning, which must include:
134134 (A) for assessment instruments, including
135135 assessment instruments under Subdivisions (1)(A)(i) and (ii), the
136136 percentage of students who met the standard for improvement, as
137137 determined by the commissioner; and
138138 (B) for evaluating relative performance, the
139139 performance of districts and campuses compared to similar districts
140140 or campuses; and
141141 (3) in the closing the gaps domain, the use of
142142 disaggregated data to demonstrate the differentials among students
143143 from different racial and ethnic groups, socioeconomic
144144 backgrounds, and other factors, including:
145145 (A) students formerly receiving special
146146 education services;
147147 (B) students continuously enrolled; and
148148 (C) students who are mobile.
149149 SECTION 3. Section 48.106, Education Code, is amended by
150150 adding Subsection (a-2) to read as follows:
151151 (a-2) In addition to the amounts under Subsections (a) and
152152 (a-1), a district is entitled to an annual allotment equal to the
153153 basic allotment, or if applicable, the sum of the basic allotment
154154 and the allotment under Section 48.101 to which the district is
155155 entitled, multiplied by:
156156 (1) 1.28 for each student enrolled in an approved
157157 Leadership Officer Training Corps program, as determined by the
158158 agency; and
159159 (2) 1.47 for each student enrolled in an approved
160160 Junior Reserve Officer Training Corps program, as determined by the
161161 agency.
162162 SECTION 4. This Act applies beginning with the 2025-2026
163163 school year.
164164 SECTION 5. This Act takes effect immediately if it receives
165165 a vote of two-thirds of all the members elected to each house, as
166166 provided by Section 39, Article III, Texas Constitution. If this
167167 Act does not receive the vote necessary for immediate effect, this
168168 Act takes effect September 1, 2025.
