77 AN ACT
88 relating to the publication of required notice by a political
99 subdivision by alternative media.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 2051, Government Code, is amended by
1212 adding Subchapter C-1 to read as follows:
1313 SUBCHAPTER C-1. NOTICE BY PUBLICATION IN MEDIA OTHER THAN
1414 NEWSPAPER
1515 Sec. 2051.081. NOTICE BY ALTERNATIVE MEDIA. (a) A
1616 political subdivision may satisfy a requirement in any other law to
1717 provide notice by publication in a newspaper by publishing the
1818 notice:
1919 (1) by media described by Subsection (c) that the
2020 political subdivision determines has greater circulation than the
2121 newspaper with the greatest circulation in the political
2222 subdivision; and
2323 (2) on the Internet websites maintained by:
2424 (A) the political subdivision; and
2525 (B) the comptroller.
2626 (b) Before providing notice by an alternative method under
2727 Subsection (a), a political subdivision must hold a public meeting
2828 about the alternative notice method. During the meeting, the
2929 political subdivision must demonstrate that the circulation of the
3030 alternative media will be greater than the circulation of the
3131 newspaper with the greatest circulation in the political
3232 subdivision.
3333 (c) The following forms of media are authorized for
3434 providing notice under Subsection (a)(1):
3535 (1) social media;
3636 (2) free newspapers;
3737 (3) school newspapers;
3838 (4) a homeowners' association newsletter or magazine;
3939 (5) utility bills;
4040 (6) direct mailings; and
4141 (7) any other form of media authorized by the
4242 comptroller.
4343 (d) A political subdivision that provides notice using
4444 alternative media under this section shall submit notice to the
4545 comptroller describing the alternative notice method that
4646 includes:
4747 (1) the number of subscribers within the political
4848 subdivision of the newspaper with the greatest circulation in the
4949 political subdivision;
5050 (2) a description of the alternative media used for
5151 the notice; and
5252 (3) the circulation of the alternative media used for
5353 the notice.
5454 (e) After receipt of the notice under Subsection (d), the
5555 comptroller shall promptly publish on the comptroller's Internet
5656 website notice as described by Subsection (a)(2), unless the
5757 comptroller requires notice by newspaper under Subsection (f) or
5858 waives the requirement under Subsection (g).
5959 (f) The comptroller may require a political subdivision to
6060 provide notice by newspaper if the comptroller:
6161 (1) determines the alternative media used by the
6262 political subdivision to provide notice under Subsection (a) does
6363 not have a greater circulation than the newspaper with the greatest
6464 circulation in the political subdivision; and
6565 (2) provides written notice to the political
6666 subdivision of the comptroller's determination under Subdivision
6767 (1).
6868 (g) A political subdivision may request from the
6969 comptroller, and the comptroller may grant, a waiver from the
7070 requirements of Subsection (a)(2) if the political subdivision
7171 provides sufficient proof that Internet access is limited in the
7272 political subdivision. If the comptroller grants the waiver, the
7373 political subdivision must provide additional notice on a public
7474 agenda board within the political subdivision.
7575 (h) Notice published under Subsection (a)(2) must be made
7676 available for the period of time required by law for which the
7777 publication of the notice is required in a newspaper.
7878 Sec. 2051.0815. COMPTROLLER ALTERNATIVE NOTICE REPORT. (a)
7979 The comptroller shall prepare a report that identifies and compares
8080 the effectiveness of different methods of notice publication used
8181 by political subdivisions. The report must include all types of
8282 notice that are used under this chapter and laws that require the
8383 publication of a notice in a newspaper by a political subdivision.
8484 (b) Not later than December 31 of each even-numbered year,
8585 the comptroller shall submit the report described by Subsection (a)
8686 to the governor, lieutenant governor, and speaker of the house of
8787 representatives.
8888 (c) This section expires January 1, 2029.
8989 Sec. 2051.082. RULEMAKING AUTHORITY. The comptroller may
9090 adopt rules necessary to administer this subchapter.
9191 SECTION 2. This Act takes effect September 1, 2025.
