77 AN ACT
88 relating to the regulation of in vitro fertilization procedures;
99 authorizing an administrative penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle H, Title 2, Health and Safety Code, is
1212 amended by adding Chapter 174 to read as follows:
1313 CHAPTER 174. IN VITRO FERTILIZATION
1414 Sec. 174.001. REGULATION OF IN VITRO FERTILIZATION
1515 PROCEDURES. Notwithstanding any other law, a physician or other
1616 health care practitioner:
1717 (1) may perform in vitro fertilization procedures only
1818 on an individual who intends to carry to term each embryo implanted
1919 during the procedures; and
2020 (2) may not terminate any unborn child in a multifetal
2121 pregnancy resulting from in vitro fertilization procedures.
2222 Sec. 174.002. ADMINISTRATIVE PENALTY. The appropriate
2323 licensing authority may impose an administrative penalty against a
2424 physician or other health care practitioner who violates this
2525 chapter in the same manner and using the same procedures as the
2626 authority uses to impose an administrative penalty against a
2727 physician or practitioner who violates the authority's licensing or
2828 other regulatory laws or rules.
2929 SECTION 2. This Act takes effect September 1, 2025.
