11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 209.00593(a), Property Code, is amended | |
13 | 13 | to read as follows: | |
14 | 14 | (a) Notwithstanding any provision in a dedicatory | |
15 | 15 | instrument, any board member whose term has expired must be elected | |
16 | 16 | by owners who are members of the property owners' association. | |
17 | 17 | If [A board member may be appointed by the board to fill] a vacancy | |
18 | 18 | occurs on the board, the board shall order a special election to | |
19 | 19 | fill the vacancy. A board member elected [appointed] to fill a | |
20 | 20 | vacant position shall serve until the next regular election of | |
21 | 21 | members to the board [for the remainder of the unexpired term of the | |
22 | 22 | position]. | |
23 | 23 | SECTION 2. This Act takes effect September 1, 2025. |
