8	8	AN ACT
9	9	relating to the enrollment period for newborns under certain
10	10	employer health benefit plans.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 846.258(b), Insurance Code, is amended
13	13	to read as follows:
14	14	(b) Coverage of a newborn child of a participating employee
15	15	under this section ends on the 61st [32nd] day after the date of the
16	16	child's birth unless:
17	17	(1) children are eligible for coverage under the
18	18	multiple employer welfare arrangement's plan document; and
19	19	(2) not later than the 60th [31st] day after the date
20	20	of birth, the arrangement receives:
21	21	(A) notice of the birth; and
22	22	(B) any required additional premium.
23	23	SECTION 2. Section 1501.157(b), Insurance Code, is amended
24	24	to read as follows:
25	25	(b) Coverage of a newborn child of a covered employee under
26	26	this section ends on the 61st [32nd] day after the date of the
27	27	child's birth unless, not later than the 60th [31st] day after the
28	28	date of birth, the small employer health benefit plan issuer
29	29	receives:
30	30	(1) notice of the birth; and
31	31	(2) any required additional premium.
32	32	SECTION 3. Section 1501.607(b), Insurance Code, is amended
33	33	to read as follows:
34	34	(b) Coverage of a newborn child of a covered employee under
35	35	this section ends on the 61st [32nd] day after the date of the
36	36	child's birth unless:
37	37	(1) children are eligible for coverage under the large
38	38	employer health benefit plan; and
39	39	(2) not later than the 60th [31st] day after the date
40	40	of birth, the large employer health benefit plan issuer receives:
41	41	(A) notice of the birth; and
42	42	(B) any required additional premium.
43	43	SECTION 4. The change in law made by this Act applies only
44	44	to a health benefit plan that is delivered, issued for delivery, or
45	45	renewed on or after January 1, 2026. A health benefit plan that is
46	46	delivered, issued for delivery, or renewed before January 1, 2026,
47	47	is governed by the law as it existed immediately before the
48	48	effective date of this Act, and that law is continued in effect for
49	49	that purpose.
50	50	SECTION 5. This Act takes effect September 1, 2025.
