77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the enrollment period for newborns under certain
1010 employer health benefit plans.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 846.258(b), Insurance Code, is amended
1313 to read as follows:
1414 (b) Coverage of a newborn child of a participating employee
1515 under this section ends on the 61st [32nd] day after the date of the
1616 child's birth unless:
1717 (1) children are eligible for coverage under the
1818 multiple employer welfare arrangement's plan document; and
1919 (2) not later than the 60th [31st] day after the date
2020 of birth, the arrangement receives:
2121 (A) notice of the birth; and
2222 (B) any required additional premium.
2323 SECTION 2. Section 1501.157(b), Insurance Code, is amended
2424 to read as follows:
2525 (b) Coverage of a newborn child of a covered employee under
2626 this section ends on the 61st [32nd] day after the date of the
2727 child's birth unless, not later than the 60th [31st] day after the
2828 date of birth, the small employer health benefit plan issuer
2929 receives:
3030 (1) notice of the birth; and
3131 (2) any required additional premium.
3232 SECTION 3. Section 1501.607(b), Insurance Code, is amended
3333 to read as follows:
3434 (b) Coverage of a newborn child of a covered employee under
3535 this section ends on the 61st [32nd] day after the date of the
3636 child's birth unless:
3737 (1) children are eligible for coverage under the large
3838 employer health benefit plan; and
3939 (2) not later than the 60th [31st] day after the date
4040 of birth, the large employer health benefit plan issuer receives:
4141 (A) notice of the birth; and
4242 (B) any required additional premium.
4343 SECTION 4. The change in law made by this Act applies only
4444 to a health benefit plan that is delivered, issued for delivery, or
4545 renewed on or after January 1, 2026. A health benefit plan that is
4646 delivered, issued for delivery, or renewed before January 1, 2026,
4747 is governed by the law as it existed immediately before the
4848 effective date of this Act, and that law is continued in effect for
4949 that purpose.
5050 SECTION 5. This Act takes effect September 1, 2025.
