77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to indicators of achievement under the public school
1010 accountability system.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 39.053(c), Education Code, is amended to
1313 read as follows:
1414 (c) School districts and campuses must be evaluated based on
1515 three domains of indicators of achievement adopted under this
1616 section that include:
1717 (1) in the student achievement domain, indicators of
1818 student achievement that must include:
1919 (A) for evaluating the performance of districts
2020 and campuses generally:
2121 (i) an indicator that accounts for the
2222 results of assessment instruments required under Sections
2323 39.023(a), (c), and (l), as applicable for the district and campus,
2424 including the results of assessment instruments required for
2525 graduation retaken by a student, aggregated across grade levels by
2626 subject area, including:
2727 (a) for the performance standard
2828 determined by the commissioner under Section 39.0241(a), the
2929 percentage of students who performed satisfactorily on the
3030 assessment instruments, aggregated across grade levels by subject
3131 area; and
3232 (b) for the college readiness
3333 performance standard as determined under Section 39.0241, the
3434 percentage of students who performed satisfactorily on the
3535 assessment instruments, aggregated across grade levels by subject
3636 area; [and]
3737 (ii) an indicator that accounts for the
3838 results of assessment instruments required under Section
3939 39.023(b), as applicable for the district and campus, including the
4040 percentage of students who performed satisfactorily on the
4141 assessment instruments, as determined by the performance standard
4242 adopted by the agency, aggregated across grade levels by subject
4343 area; and
4444 (iii) an indicator that accounts for
4545 students who successfully complete courses included in the
4646 enrichment curriculum under Section 28.002;
4747 (B) for evaluating the performance of high school
4848 campuses and districts that include high school campuses,
4949 indicators that account for:
5050 (i) students who satisfy the Texas Success
5151 Initiative (TSI) college readiness benchmarks prescribed by the
5252 Texas Higher Education Coordinating Board under Section 51.334 on
5353 an assessment instrument in reading or mathematics designated by
5454 the coordinating board under that section;
5555 (ii) students who satisfy relevant
5656 performance standards on advanced placement tests or similar
5757 assessments;
5858 (iii) students who earn dual course credits
5959 in the dual credit courses;
6060 (iv) students who enlist in the armed
6161 forces of the United States or the Texas National Guard;
6262 (v) students who earn industry
6363 certifications;
6464 (vi) students admitted into postsecondary
6565 industry certification programs that require as a prerequisite for
6666 entrance successful performance at the secondary level;
6767 (vii) students whose successful completion
6868 of a course or courses under Section 28.014 indicates the student's
6969 preparation to enroll and succeed, without remediation, in an
7070 entry-level general education course for a baccalaureate degree or
7171 associate degree;
7272 (viii) students who successfully met
7373 standards on a composite of indicators that through research
7474 indicates the student's preparation to enroll and succeed, without
7575 remediation, in an entry-level general education course for a
7676 baccalaureate degree or associate degree;
7777 (ix) high school graduation rates, computed
7878 in accordance with standards and definitions adopted in compliance
7979 with the Every Student Succeeds Act (20 U.S.C. Section 6301 et seq.)
8080 subject to the exclusions provided by Subsections (g), (g-1),
8181 (g-2), (g-3), and (g-4);
8282 (x) students who successfully completed an
8383 OnRamps dual enrollment course;
8484 (xi) students who successfully completed a
8585 practicum or internship approved by the State Board of Education;
8686 (xii) students who are awarded an associate
8787 degree; [and]
8888 (xiii) students who successfully completed
8989 a program of study in career and technical education;
9090 (xiv) students who earn an endorsement
9191 under Section 28.025(c-1); and
9292 (xv) students who earn micro-credentials or
9393 credentials of value as defined by the State Board of Education; and
9494 (C) for evaluating the performance of
9595 elementary, middle, and junior high school campuses and districts
9696 that include those campuses, indicators that account for:
9797 (i) students in grades six, seven, and
9898 eight who successfully complete and receive credit for a course
9999 designated for a grade higher than the grade in which the student is
100100 enrolled; and
101101 (ii) students in grades six, seven, and
102102 eight who successfully complete a career and technology course
103103 approved for purposes of the career and technology allotment under
104104 Section 48.106;
105105 (2) in the school progress domain, indicators for
106106 effectiveness in promoting student learning, which must include:
107107 (A) for assessment instruments, including
108108 assessment instruments under Subdivisions (1)(A)(i) and (ii), the
109109 percentage of students who met the standard for improvement, as
110110 determined by the commissioner; and
111111 (B) for evaluating relative performance, the
112112 performance of districts and campuses compared to similar districts
113113 or campuses; and
114114 (3) in the closing the gaps domain:
115115 (A)[,] the use of disaggregated data to
116116 demonstrate the differentials among students from different racial
117117 and ethnic groups, socioeconomic backgrounds, and other factors,
118118 including:
119119 (i) [(A)] students formerly receiving
120120 special education services;
121121 (ii) [(B)] students continuously enrolled;
122122 and
123123 (iii) [(C)] students who are mobile; and
124124 (B) for evaluating the school quality of
125125 elementary, middle, and junior high school campuses and districts
126126 that include those campuses, indicators described by Subdivisions
127127 (1)(A)(iii) and (1)(C).
128128 SECTION 2. This Act applies beginning with the 2025-2026
129129 school year.
130130 SECTION 3. This Act takes effect immediately if it receives
131131 a vote of two-thirds of all the members elected to each house, as
132132 provided by Section 39, Article III, Texas Constitution. If this
133133 Act does not receive the vote necessary for immediate effect, this
134134 Act takes effect September 1, 2025.
