| 9 | 9 | | relating to a biennial report on the regional allocation of mental |

| 10 | 10 | | health beds. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 533.0515(e), Health and Safety Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (e) Not later than December 1 of each even-numbered year, |
|---|
| 15 | 15 | | [the department, in conjunction with] the commission and the |
|---|
| 16 | 16 | | advisory panel[,] shall prepare and submit to the governor, the |
|---|
| 17 | 17 | | lieutenant governor, the speaker of the house of representatives, |
|---|
| 18 | 18 | | the senate finance committee, the house appropriations committee, |
|---|
| 19 | 19 | | and the standing committees of the legislature having jurisdiction |
|---|
| 20 | 20 | | over mental health and human services a report that includes: |
|---|
| 21 | 21 | | (1) a summary of the activities of the commission[, |
|---|
| 22 | 22 | | department,] and advisory panel to develop or update the bed day |
|---|
| 23 | 23 | | allocation methodology and bed day utilization review protocol; |
|---|
| 24 | 24 | | (2) an explanation of: |
|---|
| 25 | 25 | | (A) the bed day allocation methodology; |
|---|
| 26 | 26 | | (B) the outcomes of the implementation of the bed |
|---|
| 27 | 27 | | day allocation methodology by region; [, including an explanation |
|---|
| 28 | 28 | | of] |
|---|
| 29 | 29 | | (C) how the actual outcomes aligned with or |
|---|
| 30 | 30 | | differed from the expected outcomes; and |
|---|
| 31 | 31 | | (D) factors influencing the applicability of the |
|---|
| 32 | 32 | | bed day allocation methodology; |
|---|
| 33 | 33 | | (3) for planning purposes, for each region, the actual |
|---|
| 34 | 34 | | value of a bed day for the two years preceding the date of the report |
|---|
| 35 | 35 | | and the projected value of a bed day for the five years following |
|---|
| 36 | 36 | | the date of the report, as calculated by the commission |
|---|
| 37 | 37 | | [department]; |
|---|
| 38 | 38 | | (4) for each region, an evaluation of the factors in |
|---|
| 39 | 39 | | Subsection (c)(1)(A)[, including the availability of resources in |
|---|
| 40 | 40 | | the region,] that impact the use of state-funded beds in state |
|---|
| 41 | 41 | | hospitals and other inpatient mental health facilities by the |
|---|
| 42 | 42 | | patients described by Subsection (b), including: |
|---|
| 43 | 43 | | (A) the availability of resources in the region; |
|---|
| 44 | 44 | | (B) funding amounts and methodologies for the |
|---|
| 45 | 45 | | resources identified in Paragraph (A); |
|---|
| 46 | 46 | | (C) the target number and actual number of |
|---|
| 47 | 47 | | patients served; and |
|---|
| 48 | 48 | | (D) outcomes of the use of state-funded beds; |
|---|
| 49 | 49 | | (5) the outcomes of the implementation of the bed day |
|---|
| 50 | 50 | | utilization review protocol, including the peer review process |
|---|
| 51 | 51 | | identified by Subsection (c)(1)(B), and the impact of the use of the |
|---|
| 52 | 52 | | protocol on the use of state-funded beds in state hospitals and |
|---|
| 53 | 53 | | other inpatient mental health facilities by the patients described |
|---|
| 54 | 54 | | by Subsection (b); and |
|---|
| 55 | 55 | | (6) any recommendations of the [department,] |
|---|
| 56 | 56 | | commission[,] or advisory panel to enhance the effective and |
|---|
| 57 | 57 | | efficient allocation of state-funded beds in state hospitals and |
|---|
| 58 | 58 | | other inpatient mental health facilities for the patients described |
|---|
| 59 | 59 | | by Subsection (b). |
|---|
| 60 | 60 | | SECTION 2. This Act takes effect September 1, 2025. |
