77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a biennial report on the regional allocation of mental
1010 health beds.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 533.0515(e), Health and Safety Code, is
1313 amended to read as follows:
1414 (e) Not later than December 1 of each even-numbered year,
1515 [the department, in conjunction with] the commission and the
1616 advisory panel[,] shall prepare and submit to the governor, the
1717 lieutenant governor, the speaker of the house of representatives,
1818 the senate finance committee, the house appropriations committee,
1919 and the standing committees of the legislature having jurisdiction
2020 over mental health and human services a report that includes:
2121 (1) a summary of the activities of the commission[,
2222 department,] and advisory panel to develop or update the bed day
2323 allocation methodology and bed day utilization review protocol;
2424 (2) an explanation of:
2525 (A) the bed day allocation methodology;
2626 (B) the outcomes of the implementation of the bed
2727 day allocation methodology by region; [, including an explanation
2828 of]
2929 (C) how the actual outcomes aligned with or
3030 differed from the expected outcomes; and
3131 (D) factors influencing the applicability of the
3232 bed day allocation methodology;
3333 (3) for planning purposes, for each region, the actual
3434 value of a bed day for the two years preceding the date of the report
3535 and the projected value of a bed day for the five years following
3636 the date of the report, as calculated by the commission
3737 [department];
3838 (4) for each region, an evaluation of the factors in
3939 Subsection (c)(1)(A)[, including the availability of resources in
4040 the region,] that impact the use of state-funded beds in state
4141 hospitals and other inpatient mental health facilities by the
4242 patients described by Subsection (b), including:
4343 (A) the availability of resources in the region;
4444 (B) funding amounts and methodologies for the
4545 resources identified in Paragraph (A);
4646 (C) the target number and actual number of
4747 patients served; and
4848 (D) outcomes of the use of state-funded beds;
4949 (5) the outcomes of the implementation of the bed day
5050 utilization review protocol, including the peer review process
5151 identified by Subsection (c)(1)(B), and the impact of the use of the
5252 protocol on the use of state-funded beds in state hospitals and
5353 other inpatient mental health facilities by the patients described
5454 by Subsection (b); and
5555 (6) any recommendations of the [department,]
5656 commission[,] or advisory panel to enhance the effective and
5757 efficient allocation of state-funded beds in state hospitals and
5858 other inpatient mental health facilities for the patients described
5959 by Subsection (b).
6060 SECTION 2. This Act takes effect September 1, 2025.
