15 | 12 | | SECTION 1. Section 547.613(b), Transportation Code, is |

17 | 14 | | (b) Subsection (a) does not apply to: |

18 | 15 | | (1) a windshield that has a sunscreening device that: |
---|
19 | 16 | | (A) in combination with the windshield has a |
---|
20 | 17 | | light transmission of 25 percent or more; |
---|
21 | 18 | | (B) in combination with the windshield has a |
---|
22 | 19 | | luminous reflectance of 25 percent or less; |
---|
23 | 20 | | (C) is not red, blue, or amber; and |
---|
24 | 21 | | (D) does not extend downward beyond the AS-1 line |
---|
25 | 22 | | or more than five inches from the top of the windshield, whichever |
---|
26 | 23 | | is closer to the top of the windshield; |
---|
27 | 24 | | (2) a wing vent or a window that is to the left or right |
---|
28 | 25 | | of the vehicle operator if the vent or window has a sunscreening |
---|
29 | 26 | | device that in combination with the vent or window has: |
---|
30 | 27 | | (A) a light transmission of 25 percent or more; |
---|
31 | 28 | | and |
---|
32 | 29 | | (B) a luminous reflectance of 25 percent or less; |
---|
33 | 30 | | (2-a) a side window that is to the rear of the vehicle |
---|
34 | 31 | | operator; |
---|
35 | 32 | | (3) a rear window, if the motor vehicle is equipped |
---|
36 | 33 | | with an outside mirror on each side of the vehicle that reflects to |
---|
37 | 34 | | the vehicle operator a view of the highway for a distance of at |
---|
38 | 35 | | least 200 feet from the rear; |
---|
39 | 36 | | (4) a rearview mirror; |
---|
40 | 37 | | (5) an adjustable nontransparent sun visor that is |
---|
41 | 38 | | mounted in front of a side window and not attached to the glass; |
---|
42 | 39 | | (6) a direction, destination, or termination sign on a |
---|
43 | 40 | | passenger common carrier motor vehicle, if the sign does not |
---|
44 | 41 | | interfere with the vehicle operator's view of approaching traffic; |
---|
45 | 42 | | (7) a rear window wiper motor; |
---|
46 | 43 | | (8) a rear trunk lid handle or hinge; |
---|
47 | 44 | | (9) a luggage rack attached to the rear trunk; |
---|
48 | 45 | | (10) a side window that is to the rear of the vehicle |
---|
49 | 46 | | operator on a multipurpose vehicle; |
---|
50 | 47 | | (11) a window that has a United States, state, or local |
---|
51 | 48 | | certificate placed on or attached to it as required by law; |
---|
52 | 49 | | (12) a motor vehicle that is not registered in this |
---|
53 | 50 | | state; |
---|
54 | 51 | | (13) a window that complies with federal standards for |
---|
55 | 52 | | window materials, including a factory-tinted or a pretinted window |
---|
56 | 53 | | installed by the vehicle manufacturer, or a replacement window |
---|
57 | 54 | | meeting the specifications required by the vehicle manufacturer; |
---|
58 | 55 | | (14) a vehicle that is: |
---|
59 | 56 | | (A) used regularly to transport passengers for a |
---|
60 | 57 | | fee; and |
---|
61 | 58 | | (B) authorized to operate under license or permit |
---|
62 | 59 | | by a local authority; |
---|
63 | 60 | | (15) a vehicle that is maintained by a law enforcement |
---|
64 | 61 | | agency and used for law enforcement purposes; [or] |
---|
65 | 62 | | (16) a commercial motor vehicle as defined by Section |
---|
66 | 63 | | 644.001; or |
---|
