66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the eligibility of mental health professionals for the
99 Homes for Texas Heroes home loan program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 2306.5621(a), Government Code, is
1212 amended by amending Subdivision (2) and adding Subdivision (15-a)
1313 to read as follows:
1414 (2) "Home" means a dwelling in this state in which a
1515 fire fighter, corrections officer, county jailer, public security
1616 officer, peace officer, professional educator, mental health
1717 professional, veteran, or person defined as emergency medical
1818 services personnel under this section intends to reside as the
1919 borrower's principal residence.
2020 (15-a) "metal health professional" means a licensed or
2121 certified provider as defined by:
2222 (A) Section 110.001(7), Occupations Code,
2323 (B) Section 502.002(4), Occupations Code,
2424 (C) Section 502.002(5), Occupations Code,
2525 (D) Section 503.002(4), Occupations Code,
2626 (E) Section 504.001(3), Occupations Code, and
2727 (F) Section 33.006, Education Code.
2828 SECTION 2. Sections 2306.5621(b), (c), (d), (f), and (h-1),
2929 Government Code, are amended to read as follows:
3030 (b) The corporation shall establish a program to provide
3131 eligible fire fighters, corrections officers, county jailers,
3232 public security officers, peace officers, emergency medical
3333 services personnel, professional educators, mental health
3434 professionals, and veterans with low-interest home mortgage loans.
3535 (c) To be eligible for a loan under this section, at the time
3636 a person files an application for the loan, the person must:
3737 (1) be a:
3838 (A) fire fighter, corrections officer, county
3939 jailer, public security officer, peace officer, mental health
4040 professionals, veteran, or person defined as emergency medical
4141 services personnel under this section; or
4242 (B) professional educator who is employed by a
4343 school district or is an allied health or professional nursing
4444 program faculty member in this state;
4545 (2) reside in this state; and
4646 (3) have an income of not more than 115 percent of area
4747 median family income, adjusted for family size, or the maximum
4848 amount permitted by Section 143(f), Internal Revenue Code of 1986,
4949 whichever is greater.
5050 (d) The corporation may contract with other agencies of the
5151 state or with private entities to determine whether applicants
5252 qualify as fire fighters, corrections officers, county jailers,
5353 public security officers, peace officers, emergency medical
5454 services personnel, professional educators, mental health
5555 professionals, or veterans under this section or otherwise to
5656 administer all or part of this section.
5757 (f) The board of directors of the corporation shall adopt
5858 rules governing:
5959 (1) the administration of the program;
6060 (2) the making of loans under the program;
6161 (3) the criteria for approving mortgage lenders;
6262 (4) the use of insurance on the loans and the homes
6363 financed under the program, as considered appropriate by the board
6464 to provide additional security for the loans;
6565 (5) the verification of occupancy of the home by the
6666 fire fighter, corrections officer, county jailer, public security
6767 officer, peace officer, professional educator, mental health
6868 professionals, veteran, or person defined as emergency medical
6969 services personnel as the borrower's principal residence; and
7070 (6) the terms of any contract made with any mortgage
7171 lender for processing, originating, servicing, or administering
7272 the loans.
7373 (h-1) To fund home mortgage loans for eligible fire
7474 fighters, corrections officers, county jailers, public security
7575 officers, peace officers, emergency medical services personnel,
7676 professional educators, mental health professionals, and veterans
7777 under this section, the corporation may use any proceeds received
7878 from the sale of bonds, notes, or other obligations issued under the
7979 home loan program provided by this section, regardless of any
8080 amendments to the eligibility standards for loans made under the
8181 program and regardless of when the corporation received the
8282 proceeds from those bonds, notes, or other obligations issued under
8383 the program.
8484 SECTION 3. This Act takes effect immediately if it receives
8585 a vote of two-thirds of all the members elected to each house, as
8686 provided by Section 39, Article III, Texas Constitution. If this
8787 Act does not receive the vote necessary for immediate effect, this
8888 Act takes effect September 1, 2025.
