108 AN ACT
11- relating to a study conducted by the Governor's Committee on People
12- with Disabilities regarding parking for certain individuals with
9+ relating to a study conducted by the Texas Department of Motor
10+ Vehicles regarding parking for certain individuals with
1311 disabilities.
1412 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15- SECTION 1. DEFINITION. In this Act, "committee" means the
16- Governor's Committee on People with Disabilities.
17- SECTION 2. STUDY. (a) The committee, with the assistance
18- of the Department of Public Safety of the State of Texas, the Texas
19- Department of Motor Vehicles, the Texas Department of Licensing and
20- Regulation, and the Texas Demographic Center, shall conduct a study
21- on the current and future parking needs of individuals with
22- disabilities in this state, including disabled veterans and
23- individuals with a mobility impairment.
24- (b) In conducting the study, the committee shall:
13+ SECTION 1. DEFINITION. In this Act, "department" means the
14+ Texas Department of Motor Vehicles.
15+ SECTION 2. STUDY. (a) The department, with the assistance
16+ of the Department of Public Safety of the State of Texas, the
17+ Governor's Committee on People with Disabilities, and the Texas
18+ Demographic Center, shall conduct a study on the current and future
19+ parking needs of individuals with disabilities in this state,
20+ including disabled veterans and individuals with a mobility
21+ impairment.
22+ (b) In conducting the study, the department shall:
2523 (1) compile data regarding the current and projected
2624 population of individuals with disabilities in this state who may
2725 be eligible for privileged parking under Chapter 681,
2826 Transportation Code, including disabled veterans and individuals
2927 with a mobility impairment;
3028 (2) identify current laws and rules governing parking
3129 spaces or areas designated for individuals with disabilities,
3230 including the laws and rules governing the allocation of parking
3331 for individuals with disabilities; and
3432 (3) to the extent possible, collect information from
3533 local law enforcement agencies regarding the number of citations
3634 each agency has issued for a violation of Section 681.011(a) or (b),
3735 Transportation Code.
3836 SECTION 3. REPORT. Not later than December 1, 2026, the
39- committee shall submit to the governor, the lieutenant governor,
37+ department shall submit to the governor, the lieutenant governor,
4038 the speaker of the house of representatives, and each member of the
4139 legislature a written report that includes:
4240 (1) a summary of the information compiled in the
4341 study, including an analysis of the efficiency and effectiveness of
4442 the current allocation of parking to individuals with disabilities;
4543 and
46- (2) a summary of recommendations from the committee,
47- the Department of Public Safety of the State of Texas, the Texas
48- Department of Motor Vehicles, the Texas Department of Licensing and
49- Regulation, and the Texas Demographic Center, including:
44+ (2) a summary of recommendations from the department,
45+ the Department of Public Safety of the State of Texas, the
46+ Governor's Committee on People with Disabilities, and the Texas
47+ Demographic Center, including:
5048 (A) recommendations regarding the amount of
5149 parking that should be allocated for individuals with disabilities
5250 to meet the current and future demands of individuals with
5351 disabilities in this state who may be eligible for privileged
5452 parking under Chapter 681, Transportation Code, including disabled
5553 veterans and individuals with a mobility impairment; and
5654 (B) recommendations for legislative or other
5755 action.
5856 SECTION 4. EFFECTIVE DATE. This Act takes effect
5957 immediately if it receives a vote of two-thirds of all the members
6058 elected to each house, as provided by Section 39, Article III, Texas
6159 Constitution. If this Act does not receive the vote necessary for
6260 immediate effect, this Act takes effect September 1, 2025.
