77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of a municipality or county to regulate or
1010 prohibit the carrying of a firearm on the premises of certain
1111 libraries.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 229.001, Local Government Code, is
1414 amended by amending Subsection (b) and adding Subsection (d-2) to
1515 read as follows:
1616 (b) Subsection (a) does not affect the authority a
1717 municipality has under another law to:
1818 (1) require residents or public employees to be armed
1919 for personal or national defense, law enforcement, or another
2020 lawful purpose;
2121 (2) regulate the discharge of firearms or air guns
2222 within the limits of the municipality, other than at a sport
2323 shooting range;
2424 (3) except as provided by Subsection (b-1), adopt or
2525 enforce a generally applicable zoning ordinance, land use
2626 regulation, fire code, or business ordinance;
2727 (4) regulate the storage or transportation of
2828 explosives to protect public health and safety, except that 25
2929 pounds or less of black powder for each private residence and 50
3030 pounds or less of black powder for each retail dealer are not
3131 subject to regulation;
3232 (5) regulate the carrying of an air gun or firearm,
3333 other than a handgun carried by a person not otherwise prohibited by
3434 law from carrying a handgun, at a:
3535 (A) public park;
3636 (B) public meeting of a municipality, county, or
3737 other governmental body;
3838 (C) political rally, parade, or official
3939 political meeting; or
4040 (D) nonfirearms-related school, college, or
4141 professional athletic event;
4242 (6) regulate the carrying of a firearm by a person
4343 licensed to carry a handgun under Subchapter H, Chapter 411,
4444 Government Code, in accordance with Section 411.209, Government
4545 Code;
4646 (7) regulate the hours of operation of a sport
4747 shooting range, except that the hours of operation may not be more
4848 limited than the least limited hours of operation of any other
4949 business in the municipality other than a business permitted or
5050 licensed to sell or serve alcoholic beverages for on-premises
5151 consumption;
5252 (8) regulate the carrying of an air gun by a minor on:
5353 (A) public property; or
5454 (B) private property without consent of the
5555 property owner; [or]
5656 (9) except as provided by Subsection (d-1), regulate
5757 or prohibit an employee's carrying or possession of a firearm,
5858 firearm accessory, or ammunition in the course of the employee's
5959 official duties; or
6060 (10) except as provided by Subsection (d-2), regulate
6161 or prohibit the carrying of a firearm on the premises of a library
6262 established and operated by the municipality.
6363 (d-2) Subsection (b)(10) does not authorize a municipality
6464 to regulate or prohibit the carrying of a firearm by a person
6565 described by Section 46.15(a)(1) or (b)(1), Penal Code, or by a
6666 person who is otherwise authorized to carry a firearm under a
6767 license or commission issued under Chapter 1702, Occupations Code.
6868 SECTION 2. Section 236.002, Local Government Code, is
6969 amended by amending Subsection (c) and adding Subsection (e-1) to
7070 read as follows:
7171 (c) Subsection (a) does not affect the authority of a county
7272 to:
7373 (1) require a resident or public employee to be armed
7474 for personal or national defense, law enforcement, or other purpose
7575 under other law;
7676 (2) regulate the discharge of firearms or air guns in
7777 accordance with Section 235.022;
7878 (3) regulate the carrying of a firearm by a person
7979 licensed to carry a handgun under Subchapter H, Chapter 411,
8080 Government Code, in accordance with Section 411.209, Government
8181 Code;
8282 (4) except as provided by Subsection (d), adopt or
8383 enforce a generally applicable land use regulation, fire code, or
8484 business regulation; [or]
8585 (5) except as provided by Subsection (e), regulate or
8686 prohibit an employee's carrying or possession of a firearm, firearm
8787 accessory, or ammunition in the course of the employee's official
8888 duties; or
8989 (6) except as provided by Subsection (e-1), regulate
9090 or prohibit the carrying of a firearm on the premises of a library
9191 established and operated by the county.
9292 (e-1) Subsection (c)(6) does not authorize a county to
9393 regulate or prohibit the carrying of a firearm by a person described
9494 by Section 46.15(a)(1) or (b)(1), Penal Code, or by a person who is
9595 otherwise authorized to carry a firearm under a license or
9696 commission issued under Chapter 1702, Occupations Code.
9797 SECTION 3. This Act takes effect September 1, 2025.
