8	8		AN ACT
9	9		relating to coverage for mental health conditions and substance use
10	10		disorders under certain governmental health benefit plans.
11	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12		SECTION 1. Section 1355.002(b), Insurance Code, is amended
13	13		to read as follows:
14	14		(b) Except as otherwise provided by this subchapter, but
15	15		notwithstanding [Notwithstanding any provision in Chapter 1575 or
16	16		1579 or] any other law, this subchapter [Section 1355.015] applies
17	17		to:
18	18		(1) a basic coverage plan under Chapter 1551;
19	19		(2) a basic plan under Chapter 1575; [and]
20	20		(3) [(2)] a primary care coverage plan under Chapter
21	21		1579; and
22	22		(4) a plan providing basic coverage under Chapter
23	23		1601.
24	24		SECTION 2. Section 1355.003(a), Insurance Code, is amended
25	25		to read as follows:
26	26		(a) This subchapter does not apply to coverage under:
27	27		(1) a blanket accident and health insurance policy, as
28	28		described by Chapter 1251;
29	29		(2) a short-term travel policy;
30	30		(3) an accident-only policy;
31	31		(4) a limited or specified-disease policy that does
32	32		not provide benefits for mental health care or similar services;
33	33		(5) [except as provided by Subsection (b), a plan
34	34		offered under Chapter 1551 or Chapter 1601;
35	35		[(6)] a plan offered in accordance with Section
36	36		1355.151; or
37	37		(6) [(7)] a Medicare supplement benefit plan, as
38	38		defined by Section 1652.002.
39	39		SECTION 3. Section 1355.015(e), Insurance Code, is amended
40	40		to read as follows:
41	41		(e) Notwithstanding any other law, this section does not
42	42		apply to:
43	43		(1) a standard health benefit plan provided under
44	44		Chapter 1507;
45	45		(2) a basic coverage plan under Chapter 1551; or
46	46		(3) a plan providing basic coverage under Chapter
47	47		1601.
48	48		SECTION 4. Section 1355.252, Insurance Code, is amended by
49	49		adding Subsection (d) to read as follows:
50	50		(d) Notwithstanding any other law, this subchapter applies
51	51		to:
52	52		(1) a basic coverage plan under Chapter 1551;
53	53		(2) a basic plan under Chapter 1575;
54	54		(3) a primary care coverage plan under Chapter 1579;
55	55		and
56	56		(4) a plan providing basic coverage under Chapter
57	57		1601.
58	58		SECTION 5. Section 1355.255, Insurance Code, is amended to
59	59		read as follows:
60	60		Sec. 1355.255. COMPLIANCE. (a) Except as provided by
61	61		Subsection (b), the [The] commissioner shall enforce compliance
62	62		with Section 1355.254 by evaluating the benefits and coverage
63	63		offered by a health benefit plan for quantitative and
64	64		nonquantitative treatment limitations in the following categories:
65	65		(1) in-network and out-of-network inpatient care;
66	66		(2) in-network and out-of-network outpatient care;
67	67		(3) emergency care; and
68	68		(4) prescription drugs.
69	69		(b) With respect to a plan described by Section 1355.252(d),
70	70		the applicable trustee, board of trustees, or system shall enforce
71	71		compliance with Section 1355.254 by evaluating the benefits and
72	72		coverage offered by a health benefit plan for quantitative and
73	73		nonquantitative treatment limitations in the following categories:
74	74		(1) in-network and out-of-network inpatient care;
75	75		(2) in-network and out-of-network outpatient care;
76	76		(3) emergency care; and
77	77		(4) prescription drugs.
78		-	SECTION 6. Section 1551.205, Insurance Code, is amended to
79		-	read as follows:
80		-	Sec. 1551.205. LIMITATIONS. The board of trustees may not
81		-	contract for or provide a coverage plan that:
82		-	(1) excludes or limits coverage or services for
83		-	acquired immune deficiency syndrome, as defined by the Centers for
84		-	Disease Control and Prevention of the United States Public Health
85		-	Service, or human immunodeficiency virus infection; or
86		-	(2) [provides coverage for serious mental illness that
87		-	is less extensive than the coverage provided for any physical
88		-	illness; or
89		-	[(3)] may provide coverage for prescription drugs to
90		-	assist in stopping smoking at a lower benefit level than is provided
91		-	for other prescription drugs.
92		-	SECTION 7. Section 1355.003(b), Insurance Code, is
