77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the signature required on a carrier envelope for a
1010 ballot voted by mail.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 86.005, Election Code, is amended by
1313 amending Subsection (c) and adding Subsection (f) to read as
1414 follows:
1515 (c) After marking the ballot, the voter must place it in the
1616 official ballot envelope and then seal the ballot envelope, place
1717 the ballot envelope in the official carrier envelope and then seal
1818 the carrier envelope, and sign the certificate on the carrier
1919 envelope using ink on paper. Except as provided by Subsection (f),
2020 an [An] electronic signature or photocopied signature is not
2121 permitted.
2222 (f) An electronic signature or photocopied signature is
2323 permitted to the extent necessary to reasonably accommodate an
2424 individual who is unable to sign by hand.
2525 SECTION 2. Section 86.0051, Election Code, is amended by
2626 amending Subsection (b) and adding Subsection (g) to read as
2727 follows:
2828 (b) A person other than the voter who assists a voter by
2929 depositing the carrier envelope in the mail or with a common or
3030 contract carrier or who obtains the carrier envelope for that
3131 purpose must provide the person's signature, printed name, and
3232 residence address on the reverse side of the envelope. The person
3333 must sign the envelope using ink on paper. Except as provided by
3434 Subsection (g), an [An] electronic signature or photocopied
3535 signature is not permitted.
3636 (g) An electronic signature or photocopied signature is
3737 permitted to the extent necessary to reasonably accommodate an
3838 individual who is unable to sign by hand.
3939 SECTION 3. This Act takes effect September 1, 2025.
