88 AN ACT
99 relating to monetary assistance provided by the Department of
1010 Family and Protective Services to certain parents.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 264, Family Code, is
1313 amended by adding Section 264.209 to read as follows:
1414 Sec. 264.209. MONITORED RETURN ASSISTANCE PROGRAM. (a) If
1515 a court has rendered an order under Section 263.403 providing for
1616 the monitored return of a child to a parent, the department shall
1717 provide monetary assistance under this section for the duration of
1818 the monitoring period to a parent who:
1919 (1) has a family income that is less than or equal to
2020 300 percent of the federal poverty level; and
2121 (2) demonstrates to the department that economic
2222 factors, including unemployment or inability to afford housing,
2323 transportation, utilities, food, medical care, mental health care,
24- or child care are a significant barrier to reunification.

2525 (b) The department shall disburse monetary assistance
2626 provided to a parent under Subsection (a) in the same manner as the
2727 department disburses payments to a foster parent, including making
2828 a rate increase effective on the same date the department

30- reimbursement rate. Monetary assistance provided to the parent may
31- not exceed 50 percent of the department's daily basic foster care
32- rate for the care of a child.

3331 (c) The department, at its discretion and for good cause,
34- may extend the monetary assistance payments for a time period not to
35- exceed an additional six months after the date the case is dismissed
36- to support family stability after reunification. The department
37- shall decrease the monetary assistance provided to the parent by 25
38- percent each month the monetary assistance payments are extended
39- under this subsection.

4035 SECTION 2. The change in law made by this Act applies to an
4136 order rendered under Section 263.403, Family Code, regardless of
4237 whether the order was rendered before, on, or after the effective
4338 date of this Act.
4439 SECTION 3. This Act takes effect September 1, 2025.
