77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to retirees of the Teacher Retirement System of Texas who
1010 resume certain employment with a school district.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 825.4092(e), Government Code, is amended
1313 to read as follows:
1414 (e) The amounts required to be paid under Subsections (b)
1515 and (c) are not required to be paid by a reporting employer for a
1616 retiree who retired from the retirement system:
1717 (1) before September 1, 2005; or
1818 (2) on or after September 1, 2005, if:
1919 (A) the retiree's employment qualifies for an
2020 exception under Section 824.601(b-1) or 824.602(a)(3) to the loss
2121 of benefit payments described by Section 824.601(b); and
2222 (B) the reporting employer demonstrates to the
2323 Texas Education Agency that the employer cannot through reasonable
2424 efforts fill the position other than with a person working on a
2525 temporary basis.
2626 SECTION 2. The changes in law made by this Act apply to a
2727 retiree of the Teacher Retirement System of Texas regardless of
2828 whether the person retired from employment before, on, or after the
2929 effective date of this Act.
3030 SECTION 3. The changes in law made by this Act apply
3131 beginning with the 2025-2026 school year.
3232 SECTION 4. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2025.
