77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to analysis and mitigation of transportation security
1010 threats in this state.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. DEFINITIONS. In this Act:
1313 (1) "Commission" means the Public Safety Commission.
1414 (2) "Department" means the Department of Public Safety
1515 of the State of Texas.
1616 (3) "Director" means the public safety director.
1717 (4) "Division" means the Intelligence and
1818 Counterterrorism division of the department.
1919 SECTION 2. TRANSPORTATION SECURITY THREAT ANALYSIS. (a)
2020 The division shall conduct an analysis of emerging and potential
2121 future threats to transportation security in this state. The
2222 analysis must include threats posed by the following:
2323 (1) evolving tactics by terrorist organizations that
2424 may pose a catastrophic risk to an aviation or surface
2525 transportation entity;
2626 (2) explosive devices or attacks involving the use of
2727 explosives that may cause catastrophic damage to an aviation or
2828 surface transportation system;
2929 (3) the release of chemical or biological agents in
3030 either aviation or surface transportation systems;
3131 (4) cyberthreat actors seeking to undermine
3232 confidence in transportation systems or cause service disruptions
3333 that jeopardize transportation security;
3434 (5) unmanned aerial systems with the capability of
3535 inflicting harm on transportation targets;
3636 (6) individuals or groups seeking to attack soft
3737 targets, public areas, or crowded spaces of transportation systems,
3838 including attacks against transportation security personnel;
3939 (7) foreign actors seeking to exploit vulnerabilities
4040 posed by inconsistent or inadequate security screening protocols at
4141 last point of departure airports with direct flights to this state;
4242 (8) information-sharing challenges within state
4343 government and between state government and private and
4444 governmental entities; and
4545 (9) growth in passenger volume in both the aviation
4646 and surface transportation sectors in this state.
4747 (b) In conducting the analysis required under Subsection
4848 (a) of this section, the division shall engage transportation
4949 stakeholders and account for security concerns of transportation
5050 operators by:
5151 (1) convening at least three industry day events for
5252 stakeholders to hear from relevant public and private sector
5353 security partners and provide feedback on emerging threats
5454 identified by the stakeholders;
5555 (2) developing strategies to solicit consistent
5656 feedback from stakeholders across all modes of transportation and
5757 providing consistent responses to stakeholder concerns;
5858 (3) improving the quality, timeliness, and relevancy
5959 of information-sharing products disseminated by the division to
6060 stakeholders, including classified information-sharing products;
6161 (4) coordinating security incident response and
6262 communications drills, including tabletop exercises, to improve
6363 incident preparedness and response capabilities across
6464 transportation modes and among transportation systems;
6565 (5) encouraging regular communication between
6666 governmental entities responsible for transportation security and
6767 stakeholders; and
6868 (6) establishing regular opportunities for senior
6969 department leadership to engage with stakeholders regarding
7070 changes in the threat environment and ways the department can offer
7171 security support to address those changes.
7272 (c) Not later than June 1, 2026, the division shall submit
7373 the analysis required under Subsection (a) of this section to the
7474 commission and director.
7575 SECTION 3. MITIGATION. Not later than October 1, 2026, the
7676 director shall:
7777 (1) develop, as appropriate, a threat mitigation
7878 strategy for each of the threats examined in the analysis; and
7979 (2) assign appropriate department resources to
8080 address those threats based on the calculated risk or provide
8181 recommendations to the appropriate governmental entity responsible
8282 for addressing those threats.
8383 SECTION 4. REPORT. (a) Not later than November 1, 2026, the
8484 director shall:
8585 (1) prepare a report on the results of the analysis
8686 required under Section 2 of this Act and relevant mitigation
8787 strategies developed in accordance with Section 3 of this Act; and
8888 (2) notify each standing committee of the legislature
8989 with primary jurisdiction over transportation of the completion of
9090 the report and inform those committees of any relevant findings in
9191 the report as the director determines necessary.
9292 (b) Except as provided by Subsection (a) of this section,
9393 the information in the report is confidential and not subject to
9494 disclosure under Chapter 552, Government Code.
9595 SECTION 5. EXPIRATION. This Act expires December 31, 2026.
9696 SECTION 6. EFFECTIVE DATE. This Act takes effect September
9797 1, 2025.
