27 | 25 | security vulnerabilities within this state. | |
28 | 26 | (b) It is the policy of this state to exercise foresight and | |
29 | - | make reasonable preparations for a potential | |

32 | - | allies; | |
33 | - | (2) | |

37 | 37 | Sec. 438.003. DEFINITIONS. In this chapter: | |
38 | 38 | (1) "Advisory committee" means the Texas Advisory | |

48 | 48 | delivery system; | |
49 | 49 | (B) a water supply, refinement, storage, or | |
50 | 50 | delivery system; | |
51 | 51 | (C) a communications network; | |
52 | 52 | (D) an electrical power delivery system; | |
53 | 53 | (E) an emergency service system; | |
54 | 54 | (F) a transportation system or service; | |
55 | 55 | (G) a personal data or classified information | |
56 | 56 | storage system, including a cybersecurity system; or | |
57 | 57 | (H) a military installation. | |
58 | 58 | (3) "Critical procurement" means a purchase made by a | |
59 | 59 | state agency, a political subdivision of this state, or a private | |
60 | 60 | nongovernmental organization that is critical to the proper | |
61 | 61 | functioning of state services, state operations, or the operations | |
62 | 62 | of this state's critical infrastructure, or the health, safety, or | |
63 | 63 | security of this state's citizens. | |
64 | - | (4) "Drug supply chain" means the end-to-end process | |
65 | - | for manufacturing, acquiring, shipping, and vending prescription | |
66 | - | drugs beginning at any point of origin and ending in this state, | |
67 | - | including acquiring and shipping any key starting materials and | |
68 | - | active pharmaceutical ingredients necessary to manufacture and | |
69 | - | distribute prescription drugs in this state. | |
70 | - | (5) "Geopolitical conflict" means: | |

100 | 95 | (2) a representative of the Texas National Guard, | |
101 | 96 | appointed by the governor; | |
102 | 97 | (3) two members appointed by the lieutenant governor; | |
103 | 98 | (4) two members appointed by the speaker of the house | |
104 | 99 | of representatives; | |
105 | 100 | (5) the adjutant general or the adjutant general's | |
106 | 101 | designee; | |

116 | 111 | Sec. 438.103. TERMS; VACANCY. (a) Except as provided by | |

133 | 128 | (c) The advisory committee may elect additional officers | |
134 | 129 | from among its members. | |
135 | 130 | (d) The advisory committee shall establish and approve | |
136 | 131 | duties and responsibilities for advisory committee officers. | |
137 | 132 | Sec. 438.105. REIMBURSEMENT FOR EXPENSES. A member of the | |
138 | 133 | advisory committee is not entitled to compensation for service on | |
139 | 134 | the committee but is entitled to reimbursement for actual and | |
140 | 135 | necessary expenses incurred in performing committee duties as | |
141 | 136 | provided by the General Appropriations Act. | |
142 | 137 | Sec. 438.106. MEETINGS. (a) The advisory committee shall | |
143 | 138 | meet at least once every three months, with additional meetings on | |
144 | 139 | the call of: | |
145 | 140 | (1) a majority of the members of the advisory | |
146 | 141 | committee; or | |
147 | 142 | (2) the governor. | |
148 | 143 | (b) Advisory committee meetings are not subject to Chapter | |
149 | 144 | 551. | |
150 | 145 | Sec. 438.107. GIFTS AND GRANTS. The advisory committee may | |
151 | 146 | accept gifts, grants, and donations to pay for the advisory | |
152 | 147 | committee's activities under this chapter. | |
153 | 148 | SUBCHAPTER C. POWERS AND DUTIES OF ADVISORY COMMITTEE | |
154 | 149 | Sec. 438.201. GENERAL POWERS. (a) The advisory committee | |
155 | 150 | may consult with and retain external advisors to provide expertise | |
156 | 151 | and collaborative research support. | |
157 | 152 | (b) The advisory committee may conduct field | |
158 | 153 | investigations, hold hearings, receive testimony in any form, | |
159 | 154 | consult with federal and state officials, and otherwise take any | |
160 | 155 | lawful action to carry out the purposes of the advisory committee. | |
161 | 156 | Sec. 438.202. TABLETOP EXERCISE; REPORT. (a) The advisory | |
162 | 157 | committee, with assistance from the Texas National Guard, shall | |
163 | - | conduct a tabletop exercise centered on an invasion by a foreign | |
164 | - | adversary. The exercise must explore the following scenarios: | |

195 | 188 | in countries, or by companies, at risk of disruption in the event of | |

208 | 201 | (d) The advisory committee may conduct additional | |
209 | 202 | investigations following the initial report. | |
210 | - | Sec. 438.204. DRUG SUPPLY CHAIN AUDIT; REPORT. (a) In this | |
211 | - | section, "company subject to the jurisdiction of a foreign | |
212 | - | adversary" includes a state-owned enterprise of a foreign | |
213 | - | adversary, a company domiciled or headquartered in the territory of | |
214 | - | a foreign adversary, or any wholly owned or majority-owned | |

221 | - | pharmaceutical ingredients and key starting materials, that are | |
222 | - | produced in or by a foreign adversary or substantially sourced from | |
223 | - | a company subject to the jurisdiction of a foreign adversary. | |
224 | - | (c) The advisory committee shall investigate whether the | |
225 | - | prescription drugs identified under Subsection (b): | |
226 | - | (1) are of low or questionable efficacy; or | |
227 | - | (2) are toxic or contain impurities known to the | |
228 | - | United States Food and Drug Administration, the United States | |
229 | - | Department of Agriculture, or any other governmental agencies to | |
230 | - | pose a risk to human health. | |
231 | - | (d) The advisory committee shall study whether the drug | |
232 | - | supply chain of the prescription drugs identified under Subsection | |
233 | - | (b) would be disrupted in the event of a geopolitical conflict. | |

245 | - | (5) recommend alternative sourcing strategies for the | |

248 | - | alternative sourcing strategies under Subdivision (5) for | |
249 | - | prescription drugs, as necessary; and | |
250 | - | (7) determine the feasibility and cost of creating and | |
251 | - | maintaining a strategic supply of prescription drugs in the event | |
252 | - | of a geopolitical conflict. | |
253 | - | (f) The advisory committee shall submit the initial report | |
254 | - | of prescription drugs identified under this section to the governor | |
255 | - | not later than May 29, 2026. | |

326 | 267 | required by Subsection (a) unless the release is approved by a | |
327 | 268 | majority vote of the advisory committee. | |
