108 AN ACT
11- relating to the provision of information regarding a local
12- intellectual and developmental disability authority to the parents
13- or guardians of certain special education students.
9+ relating to the referral of certain students receiving special
10+ education services to a local intellectual and developmental
11+ disability authority for services or public benefits.
1412 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1513 SECTION 1. Subchapter A, Chapter 29, Education Code, is
1614 amended by adding Section 29.030 to read as follows:
17- Sec. 29.030. PROVISION OF INFORMATION REGARDING LOCAL
18- INTELLECTUAL AND DEVELOPMENTAL DISABILITY AUTHORITY. At the first
19- individualized education program committee meeting during which a
20- student's individualized education program is developed under
21- Section 29.005, a school district shall provide the parent or legal
22- guardian of a student who has an intellectual disability or a
23- developmental delay with information about services and public
24- benefits provided by the local intellectual and developmental
25- disability authority, including services under waiver programs
26- established under Section 1915(c), Social Security Act (42 U.S.C.
27- Section 1396n(c)).
15+ Sec. 29.030. REFERRAL TO LOCAL INTELLECTUAL AND
16+ DEVELOPMENTAL DISABILITY AUTHORITY. A school district shall refer
17+ each student receiving special education services under this
18+ subchapter who has or is suspected to have an intellectual or
19+ developmental disability to a local intellectual and developmental
20+ disability authority for services or public benefits, including
21+ services under a Medicaid waiver program established under Section
22+ 1915(c), Social Security Act (42 U.S.C. Section 1396n(c)).
2823 SECTION 2. This Act applies beginning with the 2025-2026
2924 school year.
3025 SECTION 3. This Act takes effect immediately if it receives
3126 a vote of two-thirds of all the members elected to each house, as
3227 provided by Section 39, Article III, Texas Constitution. If this
3328 Act does not receive the vote necessary for immediate effect, this
3429 Act takes effect September 1, 2025.
