810 AN ACT
911 relating to the confidentiality of certain information on a
1012 declaration of informal marriage.
1113 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1214 SECTION 1. Section 2.402(b), Family Code, is amended to
1315 read as follows:
1416 (b) The declaration form must contain:
1517 (1) a heading entitled "Declaration and Registration
1618 of Informal Marriage, ___________ County, Texas";
1719 (2) spaces for each party's full name, including the
1820 woman's maiden surname, address, date of birth, place of birth,
1921 including city, county, and state, and social security number, if
2022 any;
2123 (3) a space for indicating the type of document
2224 tendered by each party as proof of age and identity;
2325 (4) printed boxes for each party to check "true" or
2426 "false" in response to the following statement: "The other party is
2527 not related to me as:
2628 (A) an ancestor or descendant, by blood or
2729 adoption;
2830 (B) a brother or sister, of the whole or half
2931 blood or by adoption;
3032 (C) a parent's brother or sister, of the whole or
3133 half blood or by adoption;
3234 (D) a son or daughter of a brother or sister, of
3335 the whole or half blood or by adoption;
3436 (E) a current or former stepchild or stepparent;
3537 or
3638 (F) a son or daughter of a parent's brother or
3739 sister, of the whole or half blood or by adoption.";
3840 (5) a printed box for either party to check "Yes,
3941 please keep the identifying information on this form
4042 confidential.";
4143 (6) a printed declaration and oath reading: "I
4244 SOLEMNLY SWEAR (OR AFFIRM) THAT WE, THE UNDERSIGNED, ARE MARRIED TO
4345 EACH OTHER BY VIRTUE OF THE FOLLOWING FACTS: ON OR ABOUT (DATE) WE
4446 AGREED TO BE MARRIED, AND AFTER THAT DATE WE LIVED TOGETHER AS
4547 HUSBAND AND WIFE AND IN THIS STATE WE REPRESENTED TO OTHERS THAT WE
4648 WERE MARRIED. SINCE THE DATE OF MARRIAGE TO THE OTHER PARTY I HAVE
4749 NOT BEEN MARRIED TO ANY OTHER PERSON. THIS DECLARATION IS TRUE AND
4850 THE INFORMATION IN IT WHICH I HAVE GIVEN IS CORRECT.";
4951 (7) [(6)] spaces immediately below the printed
5052 declaration and oath for the parties' signatures; and
5153 (8) [(7)] a certificate of the county clerk that the
5254 parties made the declaration and oath and the place and date it was
5355 made.
5456 SECTION 2. Subchapter E, Chapter 2, Family Code, is amended
5557 by adding Section 2.406 to read as follows:
5658 Sec. 2.406. CONFIDENTIALITY OF CERTAIN INFORMATION. If a
5759 party to a declaration of informal marriage has checked the box
5860 described by Section 2.402(b)(5), the county clerk may not:
5961 (1) publicly publish the personally identifying
6062 information of either party, other than the names of the parties; or
6163 (2) release a copy of the declaration that includes
6264 the personally identifying information of either party, other than
6365 the names of the parties, to anyone other than a party named on the
6466 declaration or the party's legal representative.
6567 SECTION 3. Section 194.004, Health and Safety Code, is
6668 amended by amending Subsection (a) and adding Subsection (c) to
6769 read as follows:
6870 (a) Except as otherwise provided by this section,
6971 the [The] vital statistics unit shall furnish on request any
7072 information it has on record relating to any marriage, divorce, or
7173 annulment of marriage.
7274 (c) If a party to a declaration of informal marriage has
7375 checked the box described by Section 2.402(b)(5), Family Code, on
7476 the declaration, the vital statistics unit may not furnish any
7577 personally identifying information on record relating to the
7678 marriage, other than the names of the parties to the marriage, to
7779 anyone other than a party to the marriage or the party's legal
7880 representative.
7981 SECTION 4. The changes in law made by this Act apply only to
8082 a declaration of an informal marriage executed on or after the
8183 effective date of this Act. A declaration executed before the
8284 effective date of this Act is governed by the law in effect on the
8385 date the declaration was executed, and the former law is continued
8486 in effect for that purpose.
8587 SECTION 5. This Act takes effect September 1, 2025.
